YPAL SERVICE TAXING UNIT; PROVIDING TIlE DOUNDARIES OF THE UNIT; DESIGtCATING Tile GOVERNING BODY OF THE UNIT; AUTIIORIZING A TAX LEVY AS PROVIDED DY LA~; PROVIDING FOR CONSTRUCTION A~O AN EFFECTIVE DATE BE IT ORDAINED BY THE BOARD OF COUNTY CO~IMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: Pursuant to Chapter 125 of the Florida Statutes, the Ratlhead Industrial Park Street Lighting Municipal Service Taxing Unit is hereby created for the purpose of providing lighting to the residents of the unit. This unit shall be deemed a municipal service taxing or benefit unit as the same are delineated by Section 12S.O1 (q~i~Flortda ~tatutes, ~ SECTION Tl~O: The unit is described as follows: :~ ¢~ F-'- A parcel of land lying in the northeast quarter of Section?,lO, Township 48 Couth, Range 25 East, Collier County, Florida,~,betng~:~ more particularly described as follows: ~ c~ o; Corn~nct~g at the intersection of the north line of the north one- .;. hal~.Ofrthe north one-half of the south one-half of the northeast ,, quar,ter of said Section lO and the easterly right-of-way line of '' :; County Road 887 (Old U. S. 41); thence N 89o47'40" E 549,96 feet : to a point on the westerly right-of-way lihe of the Seaboard ' Coastline Railroad, said point being on a curv~ cuncave to the east : and having a radius of 22983.3 feet; thence southwesterly along the arc of said curve through a central angle of OO 27'58" for an a~c distance of 186.97 feet; thence S 89~50'10'' W 70.00 feet; , thence 500.00 feet along the arc of a curve, concave to the east, having a radius jf 23,053.3 feet and~subtendnd by a chord having a length of 499.99 feet; thence S 89~50'10'' ~ 70~.64 feet_to easterly right-of-way line of County Road 887; thence N 31°22'30" E along said right-of-way line a distance of 775.38 feet to the point of co~nencing. Said parcel contains 9.29 acres. SECTION THREE: The governing bod7 of the Unit shall be ex-officio the Board of County · Comntssioners of Collier County, Florida. SECTION FOUR: The Unit ts formed for the purpose of providing street lighting in the above described subdivision and to that end shall possess all the powers to do all things reasonably necessary to provide such services, including ownership or rental of property, poles, wires, conduits, lights, meters, and the power to maintain the same and to enter into contracts for providing same and the electric current to operate any lighting system therein installed. SECTION FIVE: For the purpose of carrying into effect this ordinance, the Board of County Commissioners shall annu4lly, at the time required by general budgetary law, make ~n itemized estimate of the amount of money required to carry out the business of the Unit for the next fiscal year, which shall be from October 1 to and including September ~0 following. The estimate shall have for what purpose the monies are required and the mount necessary to be raised by taxation within the unit. At the time and place for fixing the annual rate of taxation for county purposes, the Board shall fix and cause to be levied on all property within the unit subject to taxation m millage sufficient to 013 meet the requirements of the estimate; provided, however, the total millage shall not exceed the millage authorized by law for municipal service taxing or benefit units. SECTION SlX: Taxes herein provided for shall be assessed and collected in the same manner and form as provided for the assessment and collection of general county taxes and subject to the same fees for assessing and collecting as general county taxes. SECTION SEVEN: This ordinance shall be liberally construed to effectuate its public purpose. If any portion, phrase or word of this Ordinance is held invalid or unconstitutional, the remaining parts shall not be affected.
