Resolution 2010-237 RESOLUTION NO.1 0- 237 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF COLLIER COUNTY AND AS EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER COUNTY WATER-SEWER DISTRICT RELATING TO PETITION VAC-PL2010-772, GREG ABRAHAM, TO DISCLAIM, RENOUNCE AND VACATE THE COUNTY'S AND THE PUBLIC'S INTEREST OF AN UNUSED UTILITY EASEMENT LOCATED OVER A PORTION OF LOT 18 ON THE PLAT OF ERINWOOD - PHASE ONE, A SUBDIVISION ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 15, PAGES 3 AND 4 OF THE PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, ALL SITUATED IN SECTION 8, TOWNSHIP 49 SOUTH, RANGE 26 EAST, COLLIER COUNTY, FLORIDA, AND BEING MORE SPECIFICALLY DEPICTED ON EXHIBIT "A" WITH THE CONDITION THAT A TEMPORARY CONSTRUCTION EASEMENT TO THE WATER-SEWER DISTRICT TO ACCESS THE UTILITY FACILITIES, UPON REQUEST, WILL BE GRANTED AND RUN WITH THE LAND. ;;coo;;oz mO:::i:men Or-O-l (tlCG)O;;o wmI;;o~ ~;;o"'OO1 g]ommo 0' o~ ClD->.01 Z;;CN..... ..,0:::'0 -<o::::!;;o O^N r ~~ m ow ;;C ~~ ^ " w-o o .....G) "T1 "0..... .., S:W I -00 m )> o G) - m ~ en c ~ =i o o c ;;0 .., WHEREAS, pursuant to Section 177.101, Florida Statutes, Petitioner, Greg Abraham has requested the vacation of the County's and the Public's interest of an unused utility easement located over a portion of Lot 18 on the plat of Erinwood _ Phase One, a subdivision according to the plat thereof as recorded in Plat Book 15, pages 3 and 4 of the Public Records of Collier County, Florida, situated in Section 8, Township 49 South, Range 26 East, Collier County, Florida, and being more specifically depicted on Exhibit "A", WHEREAS, in conjunction with, and as part of Petitioner's request, Petitioner has agreed to provide a temporary construction easement to the Water-Sewer District to access the utility facilities, upon request, over the same area that is being vacated,; WHEREAS, the Board has this day held a public hearing to consider petitioner's request, and notice of said public hearing was given as required by law; and WHEREAS, the granting of the Petitioner's request will not adversely affect the ownership or right of convenient access of the property owners; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest of an unused utility easement as specifically depicted in Exhibit "A" is hereby vacated, extinguished, renounced and disclaimed, with the aforementioned condition to provide a temporary construction easement to the Water-Sewer District to access the utility facilities, upon request, over the same area that is being vacated and this action is declared to be in the Public's interest and for the Public's benefit and will run with the land, BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby directed to record a certified copy of the Resolution in the Public Records, and to make proper notation of this vacation on the recorded plat as referenced above.
