Ordinance 81-24ORDINANCE NO. 81-24__ AN ORDINANCE ~NDING ORDINANCE NO. 74-50 ~ROVIDINGc~THAT CHANGES TO THE WATER WELL PERMIT APPLICATION FEE SH~LL BE EFFECTED BY RESOLUTION ADOPTED BY THE BOAP~5~COUNTX COMMISSIONERS; PROVIDING FOR CONFLICT AND ~LABIL~TY~ PROVIDING AN EFFECTIVE DATE. ~ ~ ~ o ~tabli~h EREAS, Ordinance No. 74- 0 wes created Collier County Water Management Policy to effec~imum__beneficial use, development, conservation, and protection ~f, the water resources of Collier County; W~IEREAS, Article II, Section 2.01(2) of Ordinance No. 74-50 sets forth the requirement that each application for a permit to withdraw water shall be accompanied by a non-refundable fee of Ten ($10) Dollars; and WHEREAS, in order to more properly reflect the actual costs incurred in the processing of water well permit applications, it shall become necessary from time to time to adjust the application fee. NOW, THEREFORE BE IT ORDAINED ~Y THE BOARD OF COUNTY COMMIS- SIONERS OF COLLIER COUNTY, FLORIDA that: SECTION 1. Ordinance No. 74-50, Article II, Section 2.01(2) is hereby amended to read as follows: A. Each application for a permit shall be accompanied by a non-refundable fee as established from time to time by resolution of the Board of County Commissioners and shall be filed~with.~e County Manager in a form to include, but not be limited~o th~- following information: o (1) Date the application is filed; (2) Name and address of the applicant (if a co~pora-C~ tion, address of the local and principal business office); (3) The source of water supply (if a lake, spring, river, stream or other surface water, the name generally used in the vicinity - if a ground water source, so state); (4) Well diameter, casing depth, total depth and casing material; (5) The quantity of water a~plied for, the use to be made of the water and any limitation including the nature of the use, method of withdrawal or diversion, and facts upon which the amount of water requested is based; (6) The place and land area where the water is to be used; (7) The location of the well, or for surface water the point of diversion; (8) The total land area owned or leased by the appli- cant from which water is to be withdrawn; (9) The signature of the applicant or his agent (if a representative capacity, attach proof of authority - if a corporation, public district, county, municipality, etc., include a certified copy of the authority by which the application is made); (10) Other information required by the Board. B. The Board of County Commissioners shall have the authority to effect changes in the non-refundable application fee for water well permits by adoption of a Resolution. SECTION 2. CONFLICT AND SEVERABILITY. In the event this Ordinance conflicts with other applicable law, the more restrictive shall apply. If any portion of this Ordinance is in conflict with an ordin'ance of any municipality within Collier County, it shall not be effective within the municipality to the extent of such conflict. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent Jurisdiction, such portion s~all b~deemed a separate, distinct and independent provision~Sf such ~01ding and shall not affect the validity of the remaining portion thereof. SECTION 3. EFFECTIVE DATE. This Ordinance shall become effective as provided by law. ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, this 5th day of May, 1981.
