ORDINANCE NO. 82-112 AN ORDINANCE CREATING THE HENDERSON CREEK ROAD STREET LIGHTING MUNICIPAL SERVICE TAXING UNIT; PROVIDING TIlE BOUNDARIES OF THE UNIT; DESIGNATING THE GOVERNING BODY OF ltlE UNIT; AUTHORIZING A TAX LEVY AS PROVIDED BY LAW; PROVIDING FOR CONSTRUCTION AND AN EFFECTIVE DATE BE iT ORDAINED BY THE BOARD OF COUNTY COr~4ISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: Pursuant to Chapter 125 of the Flortda Statutes, The Henderson Creek Road Street Lighting Municipal Service Taxing Unit is hereby 'created for the purpose' of providing street ltghttng to the residents of the area hereinafter described: . All that land in Collier County, Florida lying south of the north 501.49 feet of the south half of the south half of Section 3, ' Township S1 South, Range 26 East, and lying east of State Road 951, and north and west of Henderson Creek. ,SECTION T1VO: The governing body of the Unit shall be ex-officio the Board of County Commissioners of Collier County, Florida. SECTION THREE: The Unit is formed for the purpose of providing street lighting in the above described subdivision and to that end shall possess all the powers.to do all things reasonably necessary to provide such services including ownership or rental of property poles wires, conduits, lights, meters, and the power to maintain the same and to':~ ~o ---. enter into contracts for providing the same and the electric curren~ to operate any lighting system therein installed, c~ SECTION FOUR: For the purpose of carrying into effect this Ordtna~C'e, the Board of County Commissioners shall annually, at the time required by general budgetary law, make an itemized estimate of the amount of money required to carry out the business of the Unit for the next fiscal year, which shall be from October 1 ~o and including September 30 following. The estimate shall have for what purpose the monies are required and the amount necessary to be raised by taxation within the unit. At the time and place for fixing the annual rate of taxatton~for county purposes, the Board shall fix and cause to be levied on all L property within the Unit subject to taxation a millage sufficient tc~...-' meet the requirements of the estimate; provided, however, the t~tal= .~.~ millage shall not exceed the millage authorized by law for munt'ctpal .service taxing or benefit Units. · SECTION FIVE: Taxes heretn provtded for shall be assessed and collected tn the same manner and for~ as provided for the assessment'and collection of general county taxes and subject to the same fees for assessing and collecting as general county taxes. ~ECTION SiX: This Ordinance shall be liberally construed to effectuate its publlc purpose. If any portion, p~rase or word of th{s Ordinance ts held tnvalld or unconstitutional, the remaining parts shall not be affected. S~CTION SEVEN: Effective date of this Ord{nance shall become effective as provided by law.
