INTERLOCAL AGREEMENT BETWEEN LEE COUNTY AND
COLLIER COUNTY REGARDING THE DEVELOPMENT OF
MUTUAL COMPREHENSIVE PLAN CONCURRENCY PROGR}~S
WITHIN THE BOUNDARY AREAS OF COLLIER AND LEE
COUNTIES
.
WHEREAS, The Board of County Commissioners of Collier
County
Florida desire to facilitate
cooperation in the
implementation of a mutually beneficial comprehensive plan
concurrency
management
a
defined area
within
program
encompassing the boundary between Collier County and Lee
County; and
WHEREAS, the respective Board of County Commissioners
of Collier County and Lee County have the authority pursuant to
the Florida Interlocal Cooperation Act of 1969, Section 163.01,
Florida Statutes (1991), to make the most efficient use of
their powers by cooperating on a basis of mutual advantage and
thereby to provide services and facilities in a manner and
pursuant to forms of governmental organization that will accord
best with geographic, economic population, and other factors
influencing the needs and development of local communities; and
WHEREAS,
counties may jointly exercise the powers
granted
under the provisions of
the Florida Interlocal
Cooperation Act of 1969, upon formal adoption of an official
agreement by the governing bodies involved pursuant to law; and
WHEREAS, pursuant to Section 163.3171(3) Florida
Statures (1991), no such official agreement shall be adopted by
the governing bodies involved until a public hearing on the
SUbject with due pUblic notice has been held by each governing
body involved; and
WHEREAS, Lee County Board of County Commissioners, on
February 19, 1992, adopted an Interlocal Agreement titled
INTERLOCAL AGREEMENT BETWEEN LEE COUNTY AND COLLIER COUNTY
REGARDING THE DEVELOPMENT OF MUTUAL COMPREHENSIVE PLAN
CONCURRENCY PROGRAMS WITHIN THE BOUNDARY AREAS OF COLLIER
AND LEE COUNTIES; II OOO'lo,[ 06
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:

SECTION ONE:
ADOPTION OF INTERLOCAL AGREEMENT
Collier County Board of County Commissioners, hereby adopt said
Interlocal Agreement titled: INTERLOCAL AGREEMENT BETWEEN LEE
COUNTY AND COLLIER COUNTY REGARDING THE DEVELOPMENT OF MUTUAL
COMPREHENSIVE PLAN CONCURRENCY PROGRAMS. WITHIN BOUNDARY AREAS
OF COLLIER AND LEE COUNTIES.
SECTION TWO:
EFFECTIVE DATE
Once adopted, the Interlocal Agreement described above shall
take effect ,immediately. upon the filing of the agreement by the
Clerks to. the Board of County commissioners of Collier County
and Lee County, Florida.
