A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS, CClLLIER COUNTY, FLORIDA,
APPROVING AN AMENDMENT TO THE INTERLOCAL
AGREEMENT DATED NOVEMBER 26, 1991; AN
ASSUMPTION AGREEMENT FOR THt: TRANSFER OF
THE SECTION 8 EXIS1'ING HOUSING PROGRAM, THE
RENTAL REHABILITATION DEMONSTRATION
PROGRAM, THE ~IODERATE REHABILITATION
PROGRAM, AND THE HClUSING VOUCHER PROGRAM OF
THE COUNTY OF COLLIER, STATE OF FLORIDA, TO
THE COLLIER COUNTY HOUSING AUTHORITY; THE
SECTION 8 HOUSING ASSISTANCE PAYMENTS

REHABILITATION PROGRAM AND THE HOUSING
VOUCHER PROGRAM TO THE COLLIER COUNTY
HOUSING J\UTHORITY.
WHEREAS, Collier County has administered the Section 8
Existing
Housing
program,
the
Rental
Rehabili tation
Demonstration Program, the Noderate Rehabilitation Program and
the Housing Voucher Progr2lm
hereinafter referred to as
"Program" to provide Rent2.l Assistance to very low-income
families of Collier County; 2md
WHEREAS,
Collier County Housing Authority adopted a
resolution
on November 21, 1991,
that: "authorizes and
instructs the Chairman and Becretary-Treasurer to execute the
necessary agreements to allolJ for the assumption of the Section
8 Program from Collier County subject to approval of HUD"; and
WHEREAS,
the Board ()f County
Commissioners adopted
Res~lution No. 91-791 which approved an Interlocal Agreement
between Collier County and the Collier County Housing Authority
which set forth the conditions for the. transfer of the
a4ministration of and responsibility for the Program from the
County to the Collier County Housing Authority; and which
required that the ASSUMPT;[ON AGREEMENT FOR THE TRANSFER OF
SECTION 8 EXISTING HOUSING OF COLLIER COUNTY, FLORIDA TO THE
HOUSING AUTHORITY and the SECTION 8 HOUSING ASSISTANCE PAYMENTS
PROGRAM CONTRACT OF NOVATIOn be brought back before the Board

of County Commissioners for its consideration; and
WHEREAS, the Interlocal Agreement, and a draft Assumption
Agreement, and a draft Contract of Novation were forwarded to
~
the U.S. Department of Housing and Urban Development (HUD) for
comment and approval; and
WHEREAS, the Chief Counsel. for HUD responded with a letter
dated March 13, 1992, stating that the terms of Section II.
AUDIT of the lnterlocal Agreement should be changed to agree
with the terms stated in the draft J\ssumption Agreement, and
WHEREAS, the AMENDMENT TO THE INTERLOCAL AGREEMENT DATED
NOVEMBER 26, 1991, attached to this Resolution, does change
Section
II. AUDIT to
agree with the
draft Assumption
Agreement submitted to HUD, and
WHEREAS,
the ASSUMPTION AGREEMENT, attached to this
Resolution has been modified to assure that it is in agreement
with the Interlocal Agreement and the amended Interlocal
Agreement, and
WHEREAS, the transfer c,f the Program is conti:1gent upon
final approval by HUD of the Assumption Agreement for the
Transfer of the Section 8 E~:isting Housing Program, the Rental
Rehabilitation
Demonstrat.ion
Program,
the
Moderate
Rehabilitation Program, and the Housing Voucher Program of the
County of Collier, State of Florida, to the Collier County
Housing Authority and the Section 8 Housing Assistance Payments
Pro<Jrams Contract of Novation.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
1. The Board of County Con~issioners approves and authorizes
the Chairman to execute the AMENDMENT TO THE INTERLOCAL
AGREEMENT
DATED NOVEMBER 26, 1991,
attached hereto and
incorporated herein.
2. The Board of County con:lmissioners approves and authorizes
the Chairman to execute the ASSUMPTION AGREEMENT FOR THE
