Ordinance 82-101 ORDINANCE NO. ~B-2=.1.01 _ AN ORDINANCE CREATIHG TIlE CAPE COD ESTATES STREET LIGHTING MUNICIPAL SERVICE TAXIN~i UNIT~ PR(IVIUING THE BOUNDARIES OF TIlE UNIT; DESIGI~ATING TIlE GUVLRiiING IJUDY UI: TIlE UNIT; AUTIIORIZIIlG A TAX LEVY AS PROVIDED ElY LAN; PROVIDING FOR CONSTRUCTION AND AN EFFECTIVE I)AiE BE IT ORDAINED BY THE BOARD OF COUNTY CO~41SSIONERS O~ COLLIER COUNTY, FLORIDA: SECTION ONE: Pursuant to Chapter 125 of the Flortda Statutes, The Cape Cod Estates Street Ltghttn9 HuntcJpal Service Taxing Unit Js hereby created for the purpose of providing street ltght~ng to the residents of the area hereJnafter described: The north half(N 1/2) of the northeast quarter (NE 1/4) of the southwest quarter (SW 1/4) of the southwest quarter (SN 1/4) of Section 24, TownshJp 48 South, Range 25 East, Col]Jet County, Florlda SECTION TNO: The 9overnJn9 body of the UnJt shall be ex-officio the Board of County Commissioners of Co111er County, Florida. SECTION THREE: The Unit ts formed for the purpose of provJdtng street ltghttn9 ~n the above descrJbed subdivision and to that end shall possess all the powers to do all thJngs reasonably necessary to provtde such services, ~nclud~n9 ownership or rental of property, poles, wires, conduJts,.lJghts, meters, and the power to maintain the same and to enter into contracts for provJdJn9 the same and the electrtc current to operate any l~ghtJn9 system there~n ~nstal]ed. SECTION FOUR: For the purpose of carrying Jnto effect thJs Ordft~ance,~: the Board of County Con~nJsstoners shall annually, at the ~lme rE~utredN by general budgetary law, make an ~tomJzed estJmate of the amoun~ of money requJred to carry out tho bustnoss of the Unit for the ne~ ftscal year, whtch shall be from October 1 to and Jncludtng Sep~-~mber~ following. The estimate shal~ have for. what purpose the mon~es are requtred and the amount necessary to be raised, by taxation wfthtn the Unit. At the t~me and p]ace for fJxJn9 the annual rate of taxatton for county purposes, the Board shall fJx and cause to be levted on property wJthtn the Unit sub~ect to taxatton a mJllage sufftcJent to meet the requJrements of the estimate; ~rovJded, however, the tota~ mtl~age shall not exceed the m~llage authorized by law for munJc!pal servJce taxJn9 or benefit untts. : SECTION FIVE: Taxes herein provided for shall I~ assessed and collected in the same manner and form as provided for the assessment and collection of general county taxes and subject to the same fees for assessing and collecting as general county taxes. SECTION SIX: This Ordinance shall be liberally construed to effectuate its public purpose. If any p6rtion, phrase or word of this Ordinance is held invalid or unconstitutional, the remaining parts shall not be affected. SECTION SEVEN!
