S, PROVIDING DI~FINITIONS AND EFFECTIVE DATE; AND DECLARING THE EXISTENCE OF AN EMERGENCY. ..~.~ W}{EREAS$0~^has been determined by th~ Board of County Commissioners that it is necessary to amend Ordinance No. 81-75 An order to protect and promote the public health, safety and welfare, as ~rovided in the executive summary attached hereto and incorporated herein by reference, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA~ SECTION I. Section '1 of Ordinance 81-75 shall be amended to read as follows= This ordinance is adopted pursuant to Chapters 125, and,,403 Florida Statutes a~-F~-~t{~--+(~]-.-2~{~}--~e~i~}~-6~e~e~ The purpose of this ordinance is to provide better protection for the health, safety and welfare of the residents of Collier ~ounty~ in o ambulance. ~,~-4~L~ advanced life support~ and non-em.~,rgeno~ medical trans~or tation matters, by establishing uniform county-wide standards for certification of ambulance. support, and non-emcr, gency m0dical transportation s..~. vic~ · life e~-~e~3~-~-~ge~4~ by promulgating e~mp~ete-~-~ rules and regulations for operation of all ambulances? ~ rescue companies. ~ and non-emergency medical transportation services in Collier County. SECTION II. Section 2 of Ordinance 8~-75 is amended by adding the following definition of non-emergency medical transportation services. K. ~0n-emer~ency medical transportation services shall include the provision of trans~ortation services by publicly or privately owned,.land~ ,air or water vehicle that is desl~ed~..construct~d~ reconstructed~ ~ainta~ned~ equipped, or operated for, and is used for or intended to b~ u.ed fo~...air, land, o~ water transporta~ion Words added are underlined. Words s~ekeR eh~eugh are deleted. SECTXON XV. Conflict and Severnbilityt In tho event this Ordinance conflicts with other applicable law, the more restrictive shall apply. If any section, subsection, sentence, clause~ phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision of such holding and shall not affect the validity of the remaining portion thereof. SECTION V. Declaration. of Em~enc~ and Effective Date. This Board does hereby declare that an emergency exists and that immediate enactment of this Ordinance is necessary, and by no less than four-fifths (4/Sths) vote of the membership of the Board does hereby waive notice of intent to consider this Ordinance. A certified copy of this Ordinance, as enacted, shall be filed by the Clerk of the Board with the Department of State of the State of Florida, as soon after enactment ss is practicable by depositing the same with the postal authorities of the government of the United States by certified mail, postage prepaid, to the Florida Department of State.
