BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA~ SECTION ONE~ Ordinance 75-19 (Section 7.-14 of the Collier County Code) hereby amended by adding the following to SECTION THREE of Ordinance 75-19~ The County Manager, or his designee, may administratively approve permits for the repair of existing structures where said structures have been previously constructed seaward of the coastal construction control line established herein. Complete or substantial replacement of structures shall not be conaidered repairing existing structures. Nothing contained here~n sh~l be o ~ -1~ construed to permit further encroachment beyond the~oasta-1 --- construction control line without obtaining appropriat vari c from the Board of County Commissioners. The County Ma~ager~or~ his designee, shall notify the applicant of his decisio~ to Rue or to deny a permit for such repair within fifteen days from the date the application therefor is complete. Any person aggrieved by the decision of the County Manager, or his designee, .may make an appeal to the Board of County Commissioners. The County Manager, or his designee, may issue permits for the modification or relocation of existing structures if the . property owner demonstrates to the Manager's satisfaction that a habitable structure is in imminent threat of destruction and no suitable alternative exists which would be lass deleterious to the beach and adjacent properties. The County Manager, or his designee, shall notify the petitioner of his decision within thirty (30) days from complete. Any person aggrieved by the decision, of the County Maneger, or his designee, may make an appeal to the Board of County Commissioners. SECTION'TWO: . The Board of County Commissioners hereby finds and determines that an emergency exists necessitating the immediate enactment of this Ordinance inasmuch as the threat of a hurricane or damaging storm is greatest at this time of year, and it is necessary to provide an administrative vehicle by which affected property owners may receive permission to do the necessary repairs on their seawalls. SECTION THREE~ Accordingly, an emergency is hereby declared to exist and this Ordinance, upon said declaration of a four-fifths vote of the membership of this Board., shall become effective in accordance with applicable provisions of law for the enactment of emergency ordinances.
