AN ORDINANCE AMENDING ORDINANCE NO. 76-6 SUB-
DIVISION REGULATIONS FOR THE UNINCORPORATED
AREA OF THE COASTAL AREA PLANNING DISTRICT BY
PROVIDING THAT THE FEES AS DEFINED IN ARTICLE
IX, SECTION 4 AND ARTICLE IX, SECTION 6 SHALL
BE AFFECTED BY RESOLUTION ADOPTED BY THE BOARD
OF COUNTY COMMISSIONERS; PROVIDING FOR CONFLICT
AND SEVERABILITY; AND BY PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the Public Works Division has petitioned the Board
of County Commissioners to amend the Subdivision Regulations for
the Coastal Area Planning District; and
WHEREAS, Article IX, Section 4, Paragraph A provides for a
$50.00 processing fee for the review of the construction plans
and Article IX, Section 6, Paragraph A provides for a $150.00 fee
to defray the cost of processing the final plat and a fee of 0.5%
of the estimated cost of the construction to defray the costs
incurred by the County Engineering Department; and
WHEREAS, in order to more properly reflect the actual costs
incurred in the process of reviewing the plans and inspecting the
construction of subdivisions, it shall become necessary from time
to time to adjust the review and inspection fees.

COLLIER COUNTY, FLORIDA that:
SECTION ONE:
A. ARTICLE IX, SECT/ON 4, PARAGRAPH A is hereby amended to
read a~ follows:
Construction Plans
Upon approval of the master plan as herein provided, the
developer shall, within one },ear from the date of the
approval of the master plan, prepare and sub.mit to the
County Engineer the constr,]ction plans for all of the
improvements required by th~s Ordinance No. 76-6~ along
with. a $58~ nODreimbursable review fee of 0.25% of the

B. ARTICLE IX, SECTION 6, PARAGRAPH A, SUBSECTION 2 is
hereby amended to read as follows:
A(2} A fee of 875% 0.75% of tho estimated cost of the
required improvements shall be 9aid at the time
of submittal of tho final plat to help defray the
review costs incurred and construction inspection.
SECTION ~O:
The Board of County Commission shn]l have the authority to
effect chnnges in the subdivision review/inspection fees by
adoption of a resolution.
SECTION THREE: CONFLICT AND SEVERABILIT¥
~n the event this Ordinance conflicts with other applicable
law, the more restrictive shall apply. If any section or portion
of this Ordinance is, for any reason, held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate and independent provision and
such hOlding:shall not affect the validity of the remaining

SECTION FOUR~ EFFECTIVE DATE
!This Ordinance shall become effective as provided by law.
