Ordinance 82-045 ~l~'~,I.~d.~lier County Buildin$ Code provides that a buildin$ per. it properly ieeucdacan continue in effect without any construction activity for up to six months; and, ,WItEREAS, the Building Official can, upon application, grant an extension of such permit for a period of ninety (90) additional days; and, ~IiEREAS, the Board of County Commissioners can, upon application, grant an extension of such permit for a period of an additional ninety (90) days; and, ~ERF~S, the current state of the economy is such that an emergency is deemed to exist within the construction industry; and, the Board of County Commissioners feel that there exists a need to grant relief to the construction industry in the form of additional time for the life of a permit. NOW THEREFORE BE IT ORDAINED BY THE B6ARD OF COUNTY COMHISSION~S OF COLLIER COUNTY, FLORIDA: SECTION ONE: The Collier County Building Code, Section 106.3 - Condit{bns oL~e~he'~ ~ermtt be amended by the following chengeel. The Building Official shall act upon an applicatio~for permit with plans as filed, or as emended, without unre~onab~or unnecessary delay. All permits that have been in effect for more than twelve (12) months at ,.h- tl~e of passage of this Ordinance and for which no inspection has been performed within six (6) months prior to the date of this Ordinance, are herewith cancelled unless prior written extension has been given. Suspension or abandonment shall be deemed to have occurred when an inspection has not been called for w~thin, a six (6) month period, or if the Building Official d~termines that no substantial effort toward construction has been expended within any six (6) month period. - Immediately at the conclusion of the above time pe.rioda~ the Buildinz Official may~ upon applicatio~..for those permits issued durinz the period January I, 1~81 to May 2~p l~82T approve the extension of the time limit for one additional.year provided that the followin~ conditions are met: (I) .the plans or1zinally submitted with the buildinZ permit ::~'.-- :'~pplication~ and upon which the permit was issuedt_are 'amended to comply with fill requtrements of all buildinR ~ codes aa well aa the Collier County Fire Code in effect ......... at the't~me of the re~uestl ......... SECTION T~O= Penalties An7 person vho violates C~s provisions of ~his Ordinance ahal~ subject to prosecution in the manner prescribed by general la~ end upon conviction, such person aha11 be subject to a fins, imprisonment, or both fine and imprisonment as provided by general law. SECTION THREE~ Conflict & Severabflity A. In the event this Ordinance conflicts with other applicable law, the more restrictive shall apply. If any portion of this Ordinance ia in conflict with an ordinance of any municipality vithin Collier County, it shall not be effective within the municipality to the extent of such conflict. B. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or unconstitutional by any court of competent lurisdiciton, such portion shall be deemed a separate, distinct, and independent provision of £uch holding and shell not affect the validity of the remaining portion thereof. SECTION POUR: Declaration of Emer~enc~ and Effective Da~e: This Board does hereby declare that an emergency exists and immediate enactment of ~his Ordinance is necessary, and by no less ~han four-fifths (~/Sth) vote of the membership of the Board does hereby waive notice of intent to consider the Ordinance. -A certified-copy of this Ordinance, as enacted! shall be filed by the Clerk o~.'.the Board with the Department of State of the State of ~lorids, as soon after enactmen~ as is practicable by depositing the same with th~ postal authorities of the government of the United States by certified.mail, postage prepaid, to the Plorida Department of State.
