This district shall be deemed a municipal service taxing or benefit unit as the same are delineated by Sec{ton 125.01 iq), Florida Statues. SECTION TWO: The district is described as follows: Cor~nence at the northwest corner of Sectio~ 12, Township 50 South, Range 25 East, Collier County, Florida, run S 00~18'50'' E 920.0 feet, thence N 89°41'10'' E 70.0 feet to the POINT DF BEGINNING of the parcel of land, hereinafte~ desc[ibed, thence continuing N 89°41'10" E 2,190.00 feet, thence S 0o18'50' E 1189.74 feet, thence N 8~41'10" E 1987.26 feet, thence S 0 ~3'40" W 4986.99 feet, thence S 50~54'40'' W 858.86 feet, thence N 40 25'19" W 323.10 feet, thence N 5o53'40" E 161.23 feet, thence N 35°50'23'' E 137.37 feet, thence N 22°41'13'' E 152.27 feet thence N 37~41'32" W 756.89 feet, thence !~ 73°19'43" W 92.64 feet, thence S 50 54'40" W 684.40 feet to a point on th~ northerly right-of-way ~tne of the Tamiami Trail (U. S. 41), thence N 39u05'20" W a distance of, ~360 feet more or less to a point, said point lying on a bearing of S 47~ 15'23" W and a distance of 750.00 feet from the most westerly corner of Lot 3, Block D of the Plat of The Glades Unit One, as recorded in Plat Book la, Page 83 of the public records of Collier County,Florida, thence N 47°15'23" E 1280.46 feet, thence N 2o52'43.' SECTION THREE: The governing body of the District shall be ex-officio the Board of County Commissioners of Collier County, Florida. SECTION FOUR: The District is formed for the purpose of providing street lighting in the above described subdivision and to that end shall possess all the powers to do all things reasonably necessary to provide such services, including ownership or rental of property, poles, wires, conduits, lights, meters, and the power to main~tn that"same and to enter into contracts for providing the same and the electric current~o oper~ce lighting system therein installed. ~ o cid F"-- .:, '~ r'rl SECTION FIVE: For the purpose of carrying into effect this ordinance,~he Boa:~ ~ County Corrrntssfoners shall annually, at the time required by general ~u.d~etary~w, mke an itemized estimate of the amount o~ money re'qi/ir,.ed to carry:out the business of the District for the next fiscal year, which shall be ¥~-~'6ctober 1 to and including September 30 following. The estimate shall have for what, purpose t,h?.lm~,.~)Jes are required and. the amount necessary to be ratsed by taxation wi n the .qtstr,ict, At the time and 015 place for fixing the annual rate of taxation for county purposes, the Board shall fix and cause to be levied on all property within the district subject to taxation a millage sufficient to meet the 6equirements of the estimate; provided, however, the total millage shall not exceed the millage authorized by law for municipal service taxing or benefit units. SECTION SIX: Taxes herein provided for shall be assessed and collected in the same m~nner end form as provided for the assessment and collection of general county taxes and subject to the same fees for assessing and collecting as general county taxes. SECTION SEVEN: This ordinance shall be liberally construed to effectuate its public purpose. If any portion, phrase or word of this Ordinance is held invalid or unconstitutional, the remaining parts shall not be affected.
