A-2 DISTRICTS WITHIN THE COASTAL AREA :.: PLANNING DISTRICT; AND BY PROVIDING FOR AN EFFECTIVE DATE. :-. . EE IT ORDAINED BY THE BOARD OF COUNTY ~OMMISSI OF COLLIER COUNTY, FLORIDA: SECTION ONE: Defini.ions A. Coastal Area Planning District: All of the unincorporated portions of Collier County except the following areas: Township 46 South, Ranges 28 East, 29 East and 30 East; Township 48 South, Ranges 29 East and 30 East; Township 49 South, Ranges 29 East through 34 East; Township 47 South, Range 28 East, Sections 29, 20, 31.32 33 and that portion of Sections 28, 34, and 27, lying southwest of Oil Well Grade Road (Sk-858); Township 48 South, Range 27 East, ~ections 7 through 36; Township 48 South, Range 28 East, Section 4, 5, 6, 7, 9, 15, 16, 17, 18, 19, 20, 21, 22, 27, 28, 29, 30, 31, 32, 33, 34, and that portion of Sections 3 and 10'.lying south of SR 858; Township 49 South, Range 28 East, Sections 3, 4, 5, 6, 7, 8, 9, 10, 15, 16, 17, 18, 19, 20, 21, 22, 27, 28, 29, 30, 31, 32, 33, and 34. Director: The Zoning Director of Collier County, ~ori~ SECTION TWO: Application A mobile home or trailer shall be permitted'in the ~1 an_~-~ Zoning Distric~s of the Coastal Area Planning District s~bje~to~ the following restrictions: A. A mobile home or trailer, used in connection with the agri- cultural uses is permitted on a temporary basis only, not to exceed the duration of the agricultural use for which the mobile home is per- mitred or for three (3) years, whichever shall be the shorter, provid- ing that a permit for such'temporary use is obtained from thc Director, an~ further providing that the applicant is utilizing, for such agricul- rural use a tract of five (5) acres or more, except that part lying in public road rights-of-way. Such mobile homes or trailers shall not be located closer than one hundred (100) feet from any County highway line. two hundred (200) feet from any State highway right-of-way, or five hundred (500)feet from any Fed~a~ hi,aw~ right-of-way line. ,,,c,, LiYED ~e mobile home must be removed et the termination of the per- ~ttted per£~dL- ~. Mobile home or trailer shall be permitted as a temporary ~,'II..'!~' residence whileipermSn~%Dresidence is being constructed. Upon ....... . issuance of a building permit for the construction of a permanent residence, the Director may issue a permit for temporary use of a mobile home or trailer while permanent residence is being built. The duration of such permit shall be determined by the Director but in no case may it extend beyond the expiration date of the building permit or the completion of the residence whichever is the sooner. Prior to the issuance of a final certificate of occupancy, the mobile home or trailer must be removed from the premises. SECTION THREE: Penalties Any person who violates the provisi~ns of this Ordinance shall be subject to prosecution in the manner prescribed by general law; and upon conviction, such person shall be subject to a fine, imprison- ment, or both fine and imprisonment as provided by general law. SECTION FOUR: Conflict & Severability A. In the event this Ordinance conflicts with other applicable law, the more restrictive shall apply. If any portion of this Ordinance is in conflict with an ordinance of any municipality within Collier County, it shall not be effective within Collier County, it shall not be effective within the municipality to the extent of such con- flict. B. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is, for any reason, held invalid or uncon- stitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision of such holding and shall not affect the validity of the remaining portion thereof. SEC~'ION F1VE: Declaration of Emergency and Effective Date This Board does hereby declare that an emergency exists and that immediate enactment of this Ordinance is necessary, and by no less 'than four-fifths (4/Sth) vote of the. membership of the Board does hereby waive notice of intent to consider this Ordinance. A certified copy of this Ordinance, as enacted, 'shall be filed by the Clerk of the Board with the Department of State of the State of ~lorida, as soon after enactment aa is practicable by depositing the same with the postal authorities of the government of the United States by certified mail postage prepaid, to the Florida Department of State.
