Ordinance 82-013 ORDINANCE NO. 82-~3 o~D~NANCE CREATING THE TALL PINES SUBDIVISION STREET L'IGHTJNGiMUNICIPAL SERVICE TAXING UNIT; PROVIDING THE BbUND~RIES OF TIlE UNIT; DESIGNATING TIlE GOVERNING BODY UNIT; AUTHORIZING A TAX LEVY AS PROVIDED BY LAW; PROVI'DING FOR CONSTRUCTION AND AN EFFECTIVE DATE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: Pursuant to Chapter 1PS of the Florida Statutes;.the Tall Ptnes Subdivision Street Lighting Municipal Service Taxing Unit is hereby created for the purpose of providing lighting to the residents of the unit. This unit shall be deemed a municipal service taxing or benefit unit as the same are delineated by Section 125.01 lq), Florida Statutes. SECTION TWO: The unit is described as follows: Tall Pines Subdivision as recorded in Plat Book 12, Pages 70 thru 71 inclusive of the Public Records of Collier County, Florida. SECTION THREE: The governing body of the Unit sl.~ll be ex-officio the Board of County Commissioners of Collier County, Florida. SECTION FOUR: The Unit is formed for the purpose of providing street lighting in the above described subdivision and to that end shall possess all the powers to do all things reasonably necessary to provide such servtces,'inc]uding ownership or rental of property, poles, wires, conduits, lights, meters, and the power to maintain the same and to enter into contracts for rroviding the same and the electric current to operate any lighting system therein installed. SECTION FIVE: For the purpose of carrying into effect this ordinan~ne, th~oard.~f County Commissioners shall annually, at the time required by ge~era~budget"afy-t~, make an itemized estimate of the amount of money required to carry os the ~si~ of the Unit for the next fiscal year, which shall be from October 1 t~and ~lul~ September 30 following. The estimate shall nave for what purpose the~onies~e required and the amount necessary to be raised by taxation within the unit. At the time and place for fixing the annual rate of taxation for county purposes, the Board shall fix and cause to be levied on all property within the unit subject to taxation meet the requirements of the estimate; provided, however, the exceed the millage authorized by law for municipal service a millage sufficient to total millage shall not taxing or benefit units. SECTION SIX: Taxes herein provided for shall be assessed and collected in the same manner and form as provided for the assessment and collection of general county taxes and subject to the same fees for assessing and collecting as general county taxes.
