NOW, THEREFORE, COLLIER COUNTY, declares that the real property or any portion thereof as described in Article I of this Declaration of Restrictive Covenants shall be held, transferred, sold, conveyed, used and occupied subject to the restrictive covenants set forth. ARTICLE I The real property subject to this DECLARATION OF RESTRICTIVE CONVENANTS is that real property described on Exhibit "A" to the Statutory Deed, and made a part hereof, hereinafter referred to as the Property. ARTICLE II DEFINITIONS The following words when used in this Declaration shall have the following meanings: 1. "DECLARANT' shall mean and refer to Collier County, a Political Subdivision of the State of Florida, its successors and assigns of any or all of its rights under this Declaration. 2. "OWNER" shall mean and refer to every person or persons or entity or entities who are the record owner of a fee interest in the Property, their heirs, successors, legal representatives or assigns. ARTICLE III GENERAL RESTRICTIONS 1. The Property shall at all times be operated as a not-for-profit mental health facility and this use shall run with the land and shall be binding on all parties and all persons claiming under them throughout the lifetime of the facility. 2. Should the Property cease to be used as a mental health facility, the Property shall automatically revert back to Declarant These covenants are to run with the Land and shall be binding on all parties and persons claiming under them for a period of 21 years from the date these covenants are recorded. These covenants shall be automatically extended for successive periods of 10 years unless an instrument signed by the Declarant has been recorded, agreeing to change said covenants in whole or in part. 3. At the time of the execution of these Declarations, the Property is subject to a common Site Development Plan, as amended SDP-93-004, with property owned by Declarant In the event that either Declarant or Owner initiates any alteration, modification, amendment or change to SDP-93-004 ("SDPA"), which causes both parties to be impacted, then the party applying for the change to SDP-93-004 shall be responsible for making and paying for any and all improvements required as a result of the SDPA 4. If at any time OWNER shall offer to sell, lease, donate, rent, exchange or otherwise convey an interest in the Property, or any portion thereof, to any person or entity, OWNER shall first notify DECLARANT in writing of the proposed transaction. In order to be effective, Collier County must approve the proposed transaction in writing. Such approval will not be unreasonably withheld. 5. OWNER shall obtain written permission from the DECLARANT prior to obtaining any financing wherein the land shall be used as collateral. Said financing shall be used exclusively to make improvements to the Land. Should OWNER fail to comply with this requirement, the Land will automatically revert to the DECLARANT.
