NOW, THEREFORE BE IT ORDAINED BY T}IE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA:
The Collier County Fire Prevention Code, Chapter 11-1/2 of the
Collicr County Code of Laws and Ordinances, is hereby amended as follows:
SECTION ONE
The specific sections of the "National Fire Codes, 1982 Edition,"
as published by the National Fire Protection Association (NFPA), as
listed below by NFPA code and standard number and as amended herein, are
hereby adopted by reference as the "Collier County Fire Prevention and
Protection Code" to protect the health, welfare, safety, common interest,
and convenience of the citizens, visitors, and residents of Collier
County, Florida:

1-5 - APPEAL
1-5.1 Whenever the Building Official or Public Safety
Administrator shall reject or refuse mode or manner of con-
struction proposed to be followed or materials to be used in
the erection or alteration of a building or structure, or when
it is claimed that the provisions of this code do not apply, or
that an equally good or more desirable form of construction can
be employed in any specific case, or when it is claimed that
the true intent and meaning of this code or any of the regula-
tions thereunder have been misconstrued or wrongly interpreted,
the owner of such building or structure or his duly authorized
agent, may appeal from the decision of the Building Official or
Public Safety Administrator to the Board of Adjustments and
Appeals, pursuant to the procedures as set forth in the Collier
County Ordinance establishing the Board of Adjustments and
Appeals.
1-6 - VIOI.ATION
Amend 1-6 to read ss follows:
1-6 - VIOLATIONS AND PENALTIES
If any person, firm, corporation, or other legal entity
whether public or private, shall fail or refuse to obey or
comply with, or violates, any of the provisions of this Ordi-
nance, such person, firm, corporation, or other legal entity
whether public or private, upon conviction of such offense,
shall be punished by a fime not to exceed Five Hundred Dollars
($500.00) or by Imprisonment not to exceed sixty (60) days in
the county jail, or both, in the discretion of the court.
Each day of continued violation or non-compliance shall be
considered as a separate offense. In addition, any person,
firm, corporation, or other legal entity whether public or
private, convicted under the provisions of this section shall
pay all costs and expenses involved in the case. Nothing herein
contained shall prevent the County from taking such other
lawful action in any court of competent Jurisdiction as is
necessary to prevent or remedy any violation. Such other

lawtui action shall include, but shall no[ be limited to, an
equitable action for injunctive relief and an action at law for
damage.
CHAPTER 1 - ADMINISTRATION AND ENFORCEMENT

1-10.1 The Board of County Commissioners shall estab-
lish, by ~esolution, a schedule of fees and charges for matters
pertaining to this Ordinance and allied matter~. It is the
intent of these regulations that the County shall not be
requJred to bear any part of the cost of applications made
under this Ordinance. The schedule of fees and charges shall
be posted in the office of the Building Official. The charges
listed may be chansed by resolution of the Board of County
Commissioners and are not subject to the procedure for amend-
ment of this Ordinance set out in Section ]09.
Un:il tile applicable fees or charges have been paid in
full, no action of any type or kind shall be taken on an
applicnt~on.
CHAPTER 2 - DEFINITIONS
2-1 DEFINITIONS
Amend 2-1 by adding the fo]lowing definitions:
O~'ner - Is any person, agent, firm or corporation having a
lo~al or equitable intrest in the property.
Amend definition~ to read aa follows:
Fire Marshal - Means the Building Official for new con-
struction requirements and the Public Safety Administrator for
requirements in existin~ buildings of Collier County or fire
official of a fire district which has entered into an inter-
local agreement with the county.
Fire Official - Means the Building Official for new
construction requirements and the Public Safety Administrator
for requirements Jn existing buildin~s of Collier County or

SECTION TIIREE- Repeal of Previous Ordinance
Ordinance 81-65 is hereby repealed as of the effective date of
this ordinance.
SECTION FOUR: CONFLICT AND SEVERANCE
In the event this ordinance conflicts with any other ordinance of
Collier County or other applicable law, the more restrictive shall apply.
If any phrase or portion of this ordinance is held invalid or unconsti-
tutional by any court of competent Jurisdiction, such portion shall be
deemed a separate, distinct, and independent provision and such holding
shal] not affect the validity of the remaining portion.
SECTION FIVE- Effective Date
This ordinance shall become effective upon notice that it has been
received by the Office of the Secretary of State.
