Ordinance 83-12ORDINANCE NO. 83- 12 COLLIER COUNTY PLUMBING CODE AN ORDINANCE AMENDING THE "COLLIER COUNTY BUILDING CODE" BY ADOPTING THE "STANDARD PLUMBING CODE, 1982 EDITION," INCLUDING APPENDIXES A, D, F, G, A~ND ILLUS- TRATIONS AS PUBLISHED BY THE SOUTHERN BUILDING CODE CONGRESS INTERNATIONAL, INC., AS FURTHER AMENDED BY THIS ORDINANCE; AMENDING SECTION ]06.3(a) PROVIDING FOR A SCHEDULE OF FEES AND CHARGES TO BE ESTABLISHED BY RESOLUTION; AMENDING SECTION 107.5(a) RELATING TO WATER TEST; AMENDING SECTION 110 RELATING TO VIOLA- TIONS AND PENALTIES; AMENDING CHAPTER i, ADMINISTRA- TION, TO ADD SECTION 112 PROVIDING FOR APPEAL; AMEND- lNG SECTION 302 RELATING TO DEFINITIONS; AMENDING SECTION 602.14 RELATING TO PLASTIC PIPE AND FITTINGS; AMENDING SECTION 704.2 RELATING TO LOCATION OF CLEAN- OUTS; AMENDING SECTION 704.5 RELATING TO CLEANOUT AT BASE OF STACKS; AMENDING SECTION 1205.2 RELATING TO SIZE OF WATER SERVICE LINE AND REQUIRING SHUTOFF VALVE; AMENDING SECTION 1209.3 TO ADD SUBSECTION (c) RELATING TO LOCATION OF SHUTOFF VALVE IN LIVING UNITS; REPEALING ORDINANCES 73-24, 76-39 AND 81-92; PROVIDING FOR CONFLICT AND SEVERANCE; PROVIDING FOR AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: The Collier County Building Code, Chapter 7, Article I, of the Collier County Code of Laws and Ordinances, is hereby amended as follows: SECTION ONE The "Standard Plumbing Code, 1982 Ed~tion," including Appendixes A, D, F, G, and i]luatr~tions, aa published by the Southern Building Code Congress International, Inc., and as amended herein, is adopted by re~erence as the "Collier County Plumbing Code" to protect the health, welfare, safety, common interest and convenience of the citizens, visitors, and residents of Collier County, Florida. SECTION TWO The "Standard Plumbing Code, 1982 Edition," is hereby amended to read as follows: CHAPTER I - ADMINISTRATION 106.3 - SCHEDULE OF PERMIT FEES Amend subsection (a) to read as follows: (a) The Board of County Commissioners shall oe~,tsbli~]~, b~ resolution, a schedule of fees and charges for matters per- taining to this Ordinance and allied matters. It is the intent of these regulations that the County shall not be required to bear any part of the cost of applications made under this Ordinance. The schedule of fees and charges shall be posted in the office of the Building Code Compliance Department. The charges listed may be changed by resolution of the Board of County Comissioners and are not subject to the procedure for amend- ment of this Ordinance set out in Section 112. 107.5 - METHODS OF TESTING DRAINAGE AND VENT SYSTEMS Amend subsection (a) to read as follows: (a) Water Test: Tha water test shall be applied to tha drainage system either in its entirety or in sections. If applied to the entire system, all openings in the piping shall be tightly closed, except the highest opening and the system filled with water to point of overflow. If the system is tested in sections, each opening shall be tightly plugged except the highest openings of the section under test, and each section shall be filled with water, but no section shall be tested with ]ess than a five (5) foot head of water. In testing successive sections, at least the upper five (5) feet of the next preceding section shall be tested, so that no Joint or pipe in tbs building (except the uppermost 5 feet of the system) shall have been submitted to a test of less than a five (5) foot head of water. The water shall be kept in the system, or in the portion under test, for at least fifteen (15) minutes before inspection starts; the system shall then be tight at all Joints. 110 - VIOLATIOMS AND PENALTIES Amend section to read as follows: If any person, firm, corporation, or other legal entity whether public or private, shall fail or refuse to obey or comply with, or violates..ny of the provisions of this Ordinance, such person, firm, corporation, or other legal entity whether public or private, upon conviction of such offense, shall be punished by a fine not to exceed Five Hundred Dollars ($500.00) or by imprisonment not to exceed sixty (60) days in the county Jail, or both, in the discretion of the court. Each day of continued violation or non-compliance shall (2) be considered as a separate offense. In addition, sny person, firm, corporation, or other legal entity whether public or private, convicted under the provisions of this section shall pay all costs and expenses involved in the case. Nothing herein contained aha11 prevent the County from taking such other lawful action in any court of competent Jurisdiction ss is necessary to prevent or remedy any viola- tion. Such other lawful action shall include, but shall not be limited to, an equitable action for injunctive relief and an action at law for damages. 1]2 = APPEAL Add section 112 to read as follows: 112 - APPEAL Whenever the Plumbing Official shall reject or refuse mode or manner of construction proposed to be followed or mater- tals to be used in thc erection or alteration of a building or structure, or when it is claimed that the provisions of this code do not apply, or that an equally good or more desirable form of construction can be employed in any specific case, or when it is claimed that the true intent and meaning of this code or any of the regulations thereunder have been misconstrued or wrongly interpreted, the owner of such building or structure or his duly authorized agent, may appeal from the decision of the Plumbing Official to the Board of Adjustments and Appeals, pursvant to the procedures as set forth in the Collier County Ordinance establishing the Board of Adjustments ~nd Appeals. C}~PTER III - DEFINITIONS 302 - DEFINITION OF TER>IS Amend section by adding the following definitions: OWNER - Any person, agent, firm, or corporation having a legal or equitable interest in the property. HABITABLE ROOM - A room or enclosed space used or intended to be used for living, sleeping, cooking or eating purposes, excluding bathrooms, water closet compartments, laundries, foyers, communicating corridors, atairways, closet and storage space. 017 (3) RESIDENTIAL OCCUPANCY - Is the use of s building or structure, or any portion thereof, for sleeping accommodations and is not classed as Institutional Occupancy as defined in the Collier County Building Code. CHAPTER VI - JOINTS A~ CONNECTIONS 602.14 - JOINTS FOR PLASTIC PIPE AND FITTINGS Amend section to read as follows: ABS and PVC pipe and fittings may be solvent cemented using the proper cement recommended for the particular mater- isls. Ail pipe cuts to be squsre, and both pipe and fittings to be cleaned of all soil, dirt, oil and grease. Solvent Joints shall be made according to the recommendations of the manufacturer and/or the Plastics Pipe Institute. Joints shall be allowed to dry before testing. Should any leak occur on water test, the defective Joint shall be replaced. All solvent cements used shall bear the NSF Seal of Approval for the particular cement being used. Plastic pipe and fittings for sever and water pressure lines mmy also be joined by use of elamtomeric Joints when the respective standards for the materials so specify. Joints shall comply with standards lis~ed in Table 500 for c]astomeric joints. All Joints for plastic pipe sad fittings must be installed with the application of a proper colored cleaner prior to application of solvent cement. CHAI"TKR VII - TRAPS A~D CLEANOUTS 704.2 - LOCATION Amend section :o read as follows: (a) Cleanou:s shal] be not more than fifty (50) feet apart in horizontal drainage lines of four (4) inch nominal diameter or less and not more than one hundred (I00) feet apart for larger pipes. Line cleanouts which may be rodded both ways ~hall be used whenever possible. (b) Cleanouts shall be installed in house severs of four (4) inch nominal diameter a: no: more than seventy-five (75) feet ~pert. (c~ At the locstion of se~er li~e e~iti~g the building to the aewer sy~te~ there must be a two-way c~eanou~ ~nstalled not more than five (5) feet outside of building so that house sewer may be rodded both ways. 704.5 - BASE OF STACKS Amend section to reed aa follows: A cleanout shall be installed et or near the foot of each vertical waste or soil stack. For buildings with s floor slab on fill or ground or having a crawl space of less than eighteen (18) inches beneath the floor, a cleanout will be either st the base of the stack; or the building drain shall be extended to the outside of the building and terminated not more than five (5) feet outside the bt~ilding wall, at the opposite end of the building from the sewer connection. CItAPTER XII - WATER SUPPLY AND DISTRIBUTION 1.05., - WATER SERVICE PIPING Amend section to read as follows: Water service lines shall be sized in accordance with Appendix F or designed in accordance with accepted engineering practice but in no case shall it be less than three-fourths (3/4) inch nominal diameter. Ail water piping shall have a main shutoff valve in- stalled. V~lve shall be located within 5 feet of building or on interior where service enters building. This valve is in addition to the curb stop vslve and box. 1209.3 - CONTROLS FOR FIXTURES WITHIN DWELLINGS Add subsection (c) to read as follows: (c) All living units in apartment or residential type buildings shall have s readily accessible ma~n water supply shutoff valve. This valve shall not be located behind shy fixtures or appliance~. Easy access shall be maintained on all ~upply valves. SECTION THREE: REPEAL OF PREVIOUS ORDINANCES Ordinances Nos. 73-24, 76-39 and 81-92 are hereby repealed as of the effective date of this ordinance. 70 SECTION FOLIR: CONFLICT AND SEVEP~NCE In the event th~s ordinance conflicts with any other ordinance of Collier County or oth,~r applicable law, the more restrictive shall cpply. If any phrase or portion of this ordinance is held invalid or unconsti- tutionml by any court of c~mpetent Jurisdiction, such port~on shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FIVE: EFFECTIVE DATE This Ordinance shall become effective upon notice that it has been received by the Office of the Secretary of State.
