SECTION TVO The "National Electrical Code, 1981 Edition," is hereby amended to read as follows: ARTICLE 80 - ADMINISTRATION Add Article 80 to read as follows: ARTICI.E 80 - ADMINISTRATION 80-A. - TITLE AND SCOPE 80-1 - TITLE The provisions embraced within the following chapters and sections shall constitute and be known and may be cited as "The National Electrical Code," hereafter referred to as "this code." 80-2 - CODE REMEDIAL This code is hereby declared to be remedia], and shall be construed to sec.re the beneficial interest and purposes thereof, which are health, sanitation, general public safety and welfare, by regulating installation and maintenance of all electrical equipment. 80-3 - SCOPE The provisions of this code shall apply to the instal- lation of electrical systems, including alterations, repairs, replacement, equipment, appliances, fixtures and fittings. 80-4 - MAINTENANCE All electrical systems, both existing and new, and all parts thereof, shall be maintained in a safe condition. All devices or safeguards which are required by this code shall be maintained in good working order. The maintenance of elec- trical systems shall be the responsibility of the o%mer or his designated agent. 0i7 PACE 53 80-B - ORGANIZATION 80-5 - ELECTRICAL OFFICIAL There is hereby established a section, of the Building Code Compliance Department to be called the Electrical Section, which shall be in the charge of the Building Code Compliance Director. 80-6 - INSPECTORS The Electrical Official may appoint such number of officers, inspectors, assistants, and other employees as shall be authorized from time to time. 80-C - POWERS AND DUTIES OF ELECTRICAL OFFICIAL 80-7 - RIGHT OF ENTRY The Electrical Official shall enforce the provisions of this code and he or his duly authorized representative may enter any building, structure, or premises to perform any duty imposed npon him by this code. 80-8 - STOP WORR ORDERS Upon notice from the Electrical Official that work on any electrical installation is being done contrary to the provi- sions of this code or in a dangerous or unsafe manner, such work shall be immediately stopped. Such notice shall be in writing and shall be given to the owner of much property, or to his agent, or the person doing the work, and shall state the conditions under which work may be resumed. Where any emer- gency ~xists, oral notice given by the Electrical Official shall be sufficient. 80-9 - REVOCATION OF PERMITS The Electrical Official may revoke a permit or approval issued under the provisions of this act in case there has been any false statement or misrepresentations as to the material fact in the application or plans on which the permit or approval was based. In all such cases permit fees shall not be refunded. 80-10 - UNSAFE INSTALLATIONS All electrical installations, regardless of type, which constitute a hazard to human life, health, or welfare are hereby declared illegal and the electrical power shall be 80-1! - REQUIREMENTS NOT COVERED BY CODE Any requirement necessary for the safety, strength or stability of an existing or proposed installation, or for the safety of the occupants of a building or structure, not specif- ically covered by this code, shall be determined by the Electrical Official. 80-12 - ALTERNATE MATERIALS AND ALTERNATE METHODS OF INSTALLATIONS Alternate materials and alternate methods of installations shall be approved in accordance with this Section. (a) Ex~sting structures or premises in which elec- trical installations are to be altered, repaired, or renovated, the Electrical Official has discretionary power to permit deviation from the provisions of this Code, provided that such a proposal to deviate is first sub- mitred for proper determination in order that health and safety requirements, as they pertain to electrical installa- t~ons, shall be observed. (b) Provisions of this code are not intended to prevent the use of any material, device, method of installa- t~on. or fixture, not specifically authorized, provided such alternate has been approved by the Electrical Official. (c) The Electrical Official shall require sufficient evidence to enable him to Judge whether proposed alter- nates meet the requirements cf this Code for safety and health. (d) Where there is not sufficient evidence to substantiate claims for alternates, the Electrical Offi- cial may require tests of compliance as proof to be made by an approved agency at the expense of the applicant. Tests shall be made in accordance with generally recogn- ized standards; but in the absence of such standards, the Electrical Official shall specify the test procedure. Teats may be required to be repeated if, at any time, there is reason to believe that an alternate no longer conforms to the requirements on which its approval was based. 80-13 - LIABILITY Any officer or employee, or member of any Board, charged with the enforcement of this code, acting for the local governing body in the discharge of his duties, shall not thereby render himself liable personally and he is hereby relieved from all personal liability for any damage that may occur to persons or property as a result of any act required or permitted in the discharge of his duties. 80-D - APPLICATION FOR PEP&lIT 80-14 - WHEN REQUIRED A person, firm, or corporation shall not do or cause to be done, any installations, alterations, repairs, or replacement of equipment or systems covered by the provisions of this code, with-out first having obtained the proper permit from the Electrical Official. Ordinary repairs may be made without a permit provided that such repairs shall not violate any of the provisions of this code. 80-15 - FORM The applicant shall furnish information as may be required to complete the application forms. 80-16 - DRAWINGS AND SPECIFICATIONS Whenever, in the opinion of the Electrical Official, drawings and specifications are needed to show definitely the nature and character of the work for which the application is made, the applicant shall furnish drawings and specifications. The applicant shall furnish three (3) sets of drawings and specifications for one- and two-family dwellings and four (4) sets for all commercial and multifamily projects. The appli- cant's approved set shall remain at all times on the Job. Such informatien or drawings and specifications shall be specific, and this code shall not be cited as a whole or in part, nor shall the term "legal" or its equivalent be issued as a sub- stitute for specific information. 80-17 - EXAMINATION OF DRAWINGS The Electrical Official shall examine or cause to be examined each application for a permit and the drawings and specifications which may be filed therewith, and shall aster- (5) t~in by such examination whether the installation indicated and described is in accordance with the requirementa of this code and all other pertinent laws or ordinances. 80-E - PERMIT 80-18 - ACTION ON APPLICATIONS (a) If the Electrical Official is satisfied that the work described in an application for permit and the drawings and specifications which may be filed therewith, conform to the requirements of this code, and other pertinent laws and ordi- nances, he shall issue a permit to the applicant which shall be posted on the Job site so that it is visible from the street. (b) If the application for permit and the drawings and specifications which may be filed therewith describe work which does not conform to the requirements of this code or other pertinent laws or ordinances, the Electrical Official shall not issue a permit but shall return the drawings to the applicant with his refusal to issue such a permit. Such refusal shall, when requested, be in writing and shall contain the reasons thcrelor. 8O-l~ - CONDITIONS OF TIlE t'EP~IT (a) The Electrical Official shall act upon application for a permit with plans as filed, or ns amended, without unreasonable or unnecessary delay. A permit issued shall be construed to be a license to proceed with the work and shall not he construed as authority to violate, cancel, alter, or set aside any of the provisions of this code, nor shall such issuance of a permit prevent the Electrical Official from thereafter requiring correction of errors in plans or in construction, or of violations of this code. Any permit issued shall become invalid unless the work authorized by it shall have been inspected within six (6) months after its issuance or if the work authorized by such permit is suspended or abandoned for a period of six (6) months after the time the work is inspected; provided, that for cause, one or more extensions of time for periods not exceeding ninety (90) days each, may be allowed in writing by the Electrical Official. 017 57 (b) Plans for new construction or any change in existing electrical installation over 400 amps on residential and over 400 amps on commercial or industrial shall be prepared by, and each sheet shall bear the impress seal of, a Florida registered professional engineer and shall conform with the laws of the State of Florida. The plans shall show the size of service and maximum available fault current and interrupting capacity of main and sub-feeder breakers or fuses, wires and conduit, the location of service switches and center or centers of distri- bution, and the arrangement of circuits showing the number of outlets connected thereto. The Electrical Official shall examine all plans for compliance with the Electrical Code. It shall be the duty of the Architect, Engineer and Builder to obtain meter and conduit locations from all utility companies for all types of service before construction is commenced, and be so indicmted on the drawings. (c) Tile installation of the wiring, apparatus or equip- ment for light, heat or power, within or attached to any building or premises whether ~or private or public use, shall be done in accordance with the approved plans and specifica- tions and shall conform to the Collier County Electrical Code. Any changes or omissions in tile wiring system from that shown on permitted plans must be reviewed by rile Electrical Official and rile request for the change shall be made by the permit holder, ond approved by the owner and original Engineer or his representative or engineer appointed by architect of original p]an. Four copies of the plan showing the change must be submitted with all sheets bearing the original engineer's seal as above. 80-F - FEES 80-20 - COST O¥ PERMIT Amend section to read as follows: The Board of County Commissioners shall establish, by Resolution, a schedule of fees and charges for matters per- raining to this Ordinance and allied matters. It is the intent of these regulationa that the County shall not be required to hear any part of the cost of applications made under this Ordinance. The schedule of fees and charges shall be posted in the office of the Building Code Compliance Department. The charges listed may be changed by resolution of the Board of County Commissioners and are not subject to the procedure for amend- ment of this Ordinance set out in Section 110, 80-G - INSPECTION 80-21 - INSPECTION REQUIRED All new work and such portions of existing systems as may be affected by new work, or any changes, shall be inspected to insure compliance with all the requirements of this code and to assure that the installation and construction of the electrical system is in accordance with approved plans. 80-22 - NOTIFICATION (a) Advance Notice: It shall be the duty of the permit holder to give reasonable advance notice to the Electrical Official when work is ready for inspection. (h) Reinspection: If the Electrical Official finds that the work will not pass the inspection the installer shall be required to make necessary corrections and the work shall then be resubmitted for inspection. ~]ere additional inspections are necessary, there shall be an additional fee for each such inspection as indicated in the schedule of fees and charges. g0-23 - MATI2K1AL AND LAEOR INSPECTIONS The equipment, material, power, and labor necessary for the inspection shall be furnished by the installer. 80-24 - I?¢SI'ECTIONS Any portion of any equipment intended to be concealed by any permanent portion of the building shall not be concealed until lvspected and approved by the Electrical Official. Equipment regulated by this code shall not be connected to the fuel or power supply and placed in normal operation until it complies with all applicable requirements of this code and a final inspection approval has been issued. A final inspection approval may, upon notice, be revoked by the Electrical Official if it is found that the electrical (8) syste~ fails in any respect to comply with the tequirement~ of this code. The Electrical Official may accept inspection certification reports from a nationally recognized approval agency in lieu of on-site inspection when on-site inspection is impractical. 80-H - CERTIFICATE OF APPROVAL 80-25 - FINAL INSPECTION Upon satisfactory completion and final in~pection of the electrical installation, a certificate of approval shall be l~sued by the Electrical Official. The building shall not be occupied prior to completion of ~a~d system and/or issuance of certification of approval. 80-26 - T~IPORARY APPROVAL A temporary certificate of approval may be issued for a portion or portions of an electrical system which may be safely operated prior to final completion of the building. 80-] - VIOI.ATIONS AND PENALTIES Amend section to read ss follows: If any person, firm, corporation, or other legal entity whether public or private, shall fail or refuse to obey or comply with, or violates, any of the provisions of this Ordinarce, such person, firm, corporation, or other legal entlty whether ~ublic or private, upon conviction of such offet~e, shall be punished by a fine not to exceed Five Hundred Dollars ($500.00) or by imprisonment not to exceed sixty (60) days in the county Jail, or both, in the discretion of the court. Each day of continued violation or non-compliance shsll be considered as a separate offense. In addition, any person, firm, corporation, or other legal entity whether public or private, convicted under the provisions of this Electrical Section shall pay all costs and expenses involved in the case. Nothing herein contained shall prevent the County from taking such other lawful action in any court of competent Jurisdiction as is necessary to prevent or remedy any viola- tion. Such other lawful action shall include, but shall not be limited to, an equitable action for injunctive relief and an action at law for damsgem. 017 60 80-J - AP?EALS Whenever the Electrical Official shall reject or refuse mode or manner of construction proposed to be followed or materials to be used in the erection or alteration of a build- ing or strueture, or when it is eleimed that the provisions of this code do not apply, or that an equslly good or more desir- able form of construction can be emp]oyed in say speeifie case, or when it is claimed that the true intent and meaning of this code or any of the regulations thereunder have been mis- construed or wrongly interpreted, the o~,~ner of such building or structure or h~s duly authorized agent, may appeal from the decision of the Electrical Officiel to the Board of Adjustments and Appeals, pursuant to the procedures as set forth in the Collier County Ordinance establishing the Board of Adjustments and Appeals. CHAPTER I - GENERAL ART]CI.E 100 - DEFINITIONS Amend definitions of "Dwelling" to read as follows: Dwelling: Dwelling Unit - One or more rooms for the use of one or more persons as a housekeeping unit with space for eating, living, and sleeping, and permanent provisions for cooking and s~ni tat ion. Multifnmi]y Dwelling - A building or group of buildings cennected, which contain three or more dwelling units. One-F~mlly Dwelling - A building consisting solely of one dwelling unit. Two-Family Dwelling - A building consisting solely of two dwelling units. ARTICLE 100 - DEFINITIONS Amend section by adding the following definitions: Electrical Official - The electrical official is the Building Code Compliance Director or his designee. Owner - Any person, agent, firm, or corporation having a legal or equitable interest in the property. B00 017 PAcE 6f (~o) CHAPTER 2 - WIRING DESIGN AND PROTECTION 210-8 - GROUND FAUI,T PROTECTION FOR PERSONNEL Delete section in entirety, 210-19(b) - HOUSEHOLD RANGES AND COOKING APPLIANCES Amend section to read as follows: The wiring for all electric rsnges shall be a minimum wire cspacity of 50 amperes to an approved receptacle located within three (3) feet of the range. When oven unit is separate from surface unit, each unit shall be installed on a separate circuit served with conductors of not less than 30 ampere capacity. An approved method of connection shall be provided for each unit. (A range referred to above would be a complete cooking unit, consisting of both oven and surfmce burners.) 210-52 - DWELLING UNIT RECEPTACLE OUTLETS Add subsection (g) to read as follows: (g) Refrigerators and fixed appliances shall be wired on individual minimum 20 ampere circuits. 230-2l - OVERHEAD SERVICES - OVERHEAD SUPPI.Y Add subsection (a) to read as follows: (a) Al! services shall be run in galvanized rigid threaded metal conduit or intermediate meta] conduit from mast head to meter. The diameter of a roof mast shall be ~ m~nimum oi two (2) inches. 230-23 - OVERHEAD SERVICES - SIZE AND RATING Amend section to read as follows: A minimum 100 ampere service shall be provided for all dwelliDg units and commercial structures. 23C-31 - UNDERGROUND SERVICES - SIZE AND RATING Amend section to read as follows: A minimum 100 ampere service shall be provided for all dwelling units and commercial structures. 230-41(b) - SERVICE-ENTP~\NCE CONDUCTORS - SIZE A3~D RATING Amend section to read as follows: A minimum 100 ampere service shall be provided for all dwelling units and all commercial structures. 230-43 - INSTALLATION OF SERVICE CONdUCTORS-WIRING METHODS FOR 600 VOLTS, NOMINAL, OR LESS 62 Amend section to read as follows: Service entrance conductors shall bo installed in accor- dance with the applicable requirements of this code covering the type of wiring method used and l~mited to the following methods: (1) rigid metal conduit; (2) intermediate metal conduit; (3) rigid nonmetallic conduit schedule 80 where permitted; (4) busways. 230-47 - INSTALLATION OF SERVICE COhrDUCTORS - OTHER CONDUCTORS IN RACEWAY OR CABLE Add subsection (a) to read as follows: (a) Separately metered conductors shall not be installed in the same raceway. Line and load conductors shall not be run tn the s~me raceway, trough or wire way. CHAPTER 3 - WIRING bIETI[ODS AND MATERIALS 336-3 - NONMETALLIC-SltEATHED CABLE USES PERMITTED OR NOT PERMITTED Amend section to read aa follows Approved r~gid metal or approved nonmetallic conduit, surface raceways or electric metal]lc tubing shall be required for light, beat and power in the wiring o! m~lltl-family dwellings, churches, schools, hotels, the~ters, p~bltc bulldinRs, commercial buildings, m~lnufact~ring establishments, private clubs or similar occt~pnnctes. One or two-family dwelling units ~nd multiple family structures of three stories or less may use an approved nonmetallic cable except under concrete floor slabs which shall be in rigid or nonmetallic conduit. 384-13 - PANELBOARDS - GENERAL Add subsection (a) to read as follows: (a) Ail panelboards with a neutral buss bar shall be wired with a neutral sized to code. CHAPTER 5 - SPECIAL OCCUPANCIES 550-23(a) - MOBILE HOMES SERVICE EQUIPMENT Add subsections (1), (2) and (3) to read as follows: (1) Every service to a mobile home shall have an approved main fuse or breaker located st the meter and a fuse or breaker in the mobile home. (2) No electrical power shall be supplied to a mobile home, except a travel trailer, until the home is tied down in conformity with Collier County Tie Down Regulations. (3) Pole for mounting meter and disconnect shall be Class 6 or 7 treated wood or equal, to be set a minimum of five feet (5') deep, properly preserved to protect it from decay and insect damage. CHAPTER 6 - SPECIAL EQUIPMENT 680-20(a) - UNDERWATER LIGHTING FIXTURES - GENERAl. Amend section to read as follows: (1) Swimming pool and spa lighting shall be Iow voltage supply from an approved transformer and in all other ways shall conform to the National Electric Code. All pools shall have a rough and final electrical inspection. Renumber subsection (3) as (2) Renumber subsection (4) as (3) SECTION THREE: Repeal of Previous Ordinances Ordinnnces 77-54 and 79-85 are hereby repealed ns of the effective date of this ordinance. SECTION FOUR: CONFLICT AND SEVERANCE In the event this ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this ordinance is held invalid or unconsti- tutional by any court of competent Jurisdiction, such portion sball be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the remaining portion. (13) SECTION FIVE: Effective Date This Ordinance shall become effective upon notice that it has been rcceived by the Office of the Secretary of State.
