Ordinance 83-04ORDINANCE 83- 4 AN ORDINANCE AiMENDING COLLIER COUNTY ORDINANCE NO, 77-18, THE PELICAN BAY PLANNED UNIT DEVELOPMENT DOCUMENT, BY PROVIDING A DEFINITION OF A HOTEL OR MOTEL UNIT AND BY AMENDING SECTIONS 7.04.05 and 10,07 TO PROVIDE A MINIMUM SQUAAE FOOTAGE REQUIREMENT FOR HOTEL AND MOTEL UNITS, AND TO PROVIDE AN EFFECTIVE DATE. WHEREAS, Westinghouse Communities of Naples, Inc. (formerly known as Coral Ridge-Collier Properties, Inc.), Petitioner, has petitioned the Board of County Commissioners of Collier County to Amend Ordinance 77-18; and WHEREAS, the proposed amendment is in the interest of textual clarity for present and future interpretation; and WHEREAS, the proposed amendment does not affect the General Plan of Development of Pelican Bay; and ~tEREAS, adoption of this amendment will not result in any substantial deviation From the previously approved development of regional impact~ NOW THEREFORE BE IT ORDAINED by the Board of County Commissioners of Collier County, Florida; SECTION ONE: Section 2.15 (Definitions) is hereby amended by adding an additional subsection to read as follows: (2) "Hotel or Motel Unit" means a unit designed for transient occupancy and utilized for rental to transients. A hotel or motel unit may have cooking or eating facilities. A hotel or motel unit shall contain bathing and sanitary facilit'es. SECTION TWO: Section 7.04.05 is hereby amended by renumbering the existing text as subsection {Al and by adding additional language as subsection (B). He~eforth, Section 7.04.05 shall read as follows: 7.04.05. MINIIqUM LIVING AREA OF PRINCIPAL STRUCTURES: A. Those principal use structures which are identified in Section 7.03A shall contain a minimum of seven hundred and fifty (750) gross square feet of living area per dwelling unit within principal structure. B. The minimum living area of any hotel or motel unit permitted under Section 7.038 shall be three hundred (300) square feet. There shall be no maximum square footage.
