Ordinance 83-02ORDINANCE NO. 83- 2 AN ORDINANCE PURSUANT TO SECTION 125.0104, FLORIDA STATUTES, ESTABLISHING THE COLLIER COUNTY TOURIST DEVELOPMENT COUNCIL, PROVIDING FOR MEMBERSHIP ON AND RESPONSIBILITIES OF THE COUNCIL, AND AN EFFECTIVE DATE WHEREAS, it has been determined by the Board of County Commissioners that it is in the best interest of the County to appoint a Tourist Development Council to consider the feasibility of establishing by ordinance a Tourist Development Tax as set forth in Section 125.0104, Florida Statutes. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION I. Purpose. This ordinance is adopted pursuant to Section 125.0104, Florida Statutes, for the purpose of establishing the Collier County Tourist Development Council. SECTION II. Membership. The Collier County Tourist Development Council shall be composed of nine (9) members who shall be appointed by the Collier County Board of County Commissioners. The Chairman of the Board of County Commissioners shall be the Chairman of the Tourist Development Council. Two (2) members of the Tourist Development Council shall be elected municipal officials. Three (3) members of the Tourist Development Council shall be owners or operators of motels, hotels, or other tourist accomodations in Collier County and shall be subject to any tourist development tax levied pursuant to Section 125.0104, Florida Statutes. Three (3) members of the Tourist Development Council shall be persons who are involved in the tourist industry and who have demonstrated an interest in tourist development, but who are not owners or operators of motels, hotels, or other tourist accomodations in Collier County which would be subject to any tou.r, ist development tax. The members of the Council shall serve, fOE sta~g'ered terms of four (4) years. The terms of office of the '0rigi~al members shall be prescribed in a resolution adopt, ed by th?.B°ard of County Commissioners. o9 SECTION III, Responsibilities. A. The Tourist Development Council shall be responsible for considering the feasibility of placing before the voters of Collier County an ordinance which would impose a tourist development tax pursuant to Section 125.0104, Florida Statutes. The Tourist Development Council shall study the potential uses of any tax revenues and shall advise the Board of County Commissioners of its findings and recommendations. In the event that the Board of County Commissioners desires to submit for referendum to the voters of Collier County an ordinance levying a tourist development tax, the Tourist Development Council shall be responsible for preparation and submittal to the Board of County Commissioners of a plan for tourist development. B. The Tourist Development Council shall make recommendations to the County Commission for the effective operation of the special projects or for uses of the tourist development tax revenue and perform such other duties as may be prescribed by subsequent ordinance or resolution. SECTION IV. Effective Date. This Ordinance shall become effective upon filing with the Secretary of State.
