RESOLUTION NO. 2010 - 204
A RESOLUTION REQUESTING THAT THE FLORIDA DEPARTMENT
OF TRANSPORT A TION QUITCLAIM TO COLLIER COUNTY
CERTAIN RIGHT-OF-WAY SITUATED IN THE SOUTHEAST
QUADRANT OF THE IMMOKALEE ROAD AND INTERSTATE 1-75
INTERCHANGE AND DECLARING THAT THE RIGHT-OF-WAY IS TO
BE USED FOR PUBLIC PURPOSE ONLY.
WHEREAS, in accordance with provisions of Section 335.0415, Florida Statutes, the
State of Florida Department of Transportation (hereinafter referred to as "FDOT") has the
authority to transfer jurisdiction of roads and rights-of-way from the State Highway System to
local governmental entities, provided there is mutual approval of the transfer by FDOT and the
affected local government entity; and
WHEREAS, FDOT currently has title to certain right-of-way situated in the southeast
quadrant of the Immokalee Road and Interstate 1-75 interchange, more fully described in Exhibit
"A", attached hereto and incorporated herein (hereinafter referred to as "the right-of-way"); and
WHEREAS, Collier County desires for FDOT to transfer jurisdiction of the right-of-way
from the State Highway System to the jurisdiction of Collier County; and
WHEREAS, the Collier County Board of County Commissioners has determined that it
is in the best interest of the citizens of Collier County for the County to accept title to the right-
of-way and the jurisdiction therefor; and
WHEREAS, the right-of-way is to be conveyed for public purpose use only.
NOW THEREFORE BE IT RESOLVED that the Collier County Board of County
Commissioners does hereby request the Florida Department of Transportation to transfer unto
Collier County jurisdiction for, and all right, title and interest in and to certain right-of-way
situated in the southeast quadrant of the Immokalee Road and Interstate 1-75 interchange, and

more fully described in Exhibit "A", and does hereby authorize its Chairman to execute any
agreement or other instrument pertaining to said transfer.
AND IT IS FURTHER RESOLVED that the right-of-way shall be put to public purposes.

Being described as follows:
Commence at the northeast corner of said Section 30; thence
along the north line of said Section 30, South 89'34'01" Nest a
distance of 1,664.52 feet to the survey base line of State Road
93 (I-75); thence along said survey base line, South 00'28'42"
East a distance of 1,133.79 feet; thence leaving said survey
base line, North 89"31'18" East a distance of 221.76 feet to the
easterly existing limited access right of way line of said State
Road 93 (per Section 03175-2(01) for a POINT OF BEGINNING and
the beginning of a curve having a radius of 3,725.72 feet;
thence along said easterly existing limited access right of way
line the following four (4) courses; l)thence along the arc of
said ~urve to the right a distance of 369.50 .feet through a
central angle of 05.40'55" with a chord bearing North 09'57'12"
East to the end of said curve; 2) North 12'47'40" East a
distanGe of 426.04 feet; 3) North 51'33'29" East a distance of
334.18 feet; 4) North 96'54'02" East a distance of 74.56 feet to
the end of said courses and to the easterly existing limited
access right of way line of said State Road 93 (per Section
03175-000 FP No. 4063133) and the beginning of a curve having a
radius of 71.00 feet; thence along said easterly existing
limited access right of way line the following five (5) courses;
1) thence along the arc of said curve to the left a distance of
47.53 :eet throu~h a central angle of 39021'21" with a chord
bearinq South 22 25'10" West to the end of said curve; 2) South
03014'41" West a distance of 184.20 feet to the beginning of a
curve having a radius of 341.00 feet; 31 thence along the arc of
