Ordinance 84-43 ORDINANCE NO. 84- A~ AN ORDINANCE AMENDING ORDINANCE NO. 81-53 TO PROVIDE THAT ALL COUNTY HEALTH DEPARTMENT INSPECTORS ARE EMPOWERED TO ISSUE NOTICES OF VIOLATION AND TO TAKE LEGAL ACTION TO ENFORCE THE PROVISIONS OF ORDINANCE NO. 81-53! PROVIDING AN EFFECTIVE DATE. WHEREAS, SECTION 8. (Enforcement) of Ordinance No. 81-53 provides that 'The provisions of this Ordinance may be enforced by any law enforcement officer having Jurisdiction in the County." and WHEREAS, ].aw enforcement officer is defined as officers who have completed law enforcement training required by State law; and WHEREAS, because of the nature of the provisions contained in Ordinance No. 81-53, as may be amended from time to time, County Health Department inspectors should be empowered to issue notices of violation to insure compliance with the provisions of Ordinance No. 81-53; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER· COUNTY, FLORIDA thatI SECTION A. Zn the event that the violation is not cured as provided for within the ~oticet then the notice of violation and all supporting documentation shall he turned over to the State Attorney's Office for prosecution pursuant to the provisions of SECTION 7. In addition to the remedies contained in SECTION 7r Collier County is empowered to take,, any and all other legal ac~iont including but not limited, to seeking injunctive relief in the ,Circuit Courts of Collier county, to enforce the provisions of Ordinance No. 81-53. * * * * SECTION B.
