Ordinance 84-15ORDINANCE NO. 84- 15 AN ORDINANCE CREATING THE IMPERIAL GOLF ESTATES I ACCESS ROAD LIGHTING MUNICIPAL SERVICE TAXING UNIT; DESIGNATING THE GOVERNING BODY OF THE DISTRICT; AUTHORIZING A TAX LEVY OF UP TO TEN MILLS; PROVIDING FOR CONSTRUCTION AN]) AN EFFECTIVE DATE .... BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONEgS OF COLLIER COUNTY, FLORIDA; SECTION I, Pursuant to Chapter 125 of the Florida Statutes; the Imperial Golf Estates I Access Road Lighting Municipal Service Taxing Unit is hereby created for the purpose of providing street lighting to the residents of the area hereinafter described: ,. IMPERIAL GOLF ESTATES I ACCESS ROAD: An access easement lyihg in the S h of Section 15 and the SW R of Section {&, To.ship 48 S, R~nge 2~, Collier County, Florida, more particularly described as follows~ From ~he SW corner of said Section ~5 run N89'58'37" E for 15.~ ~h. SECTION 2. The governing body of the District shall be ex-officio the Board of County Co~t.sioners of Collier County, Florida. SE~ION 3. ~. District is fo~ed for the purpose of providing street lighting in the above describmd scces~ road and to that end shall possess all the p~rs :o do all ~hin~s reasonably necessary ~o provide such s~ices, includin~ ~rship or ten:al of prop~r~y, po~s, wires, conduits, lights, meCars, and ~he power to maintain the same and to enter into contracts for providing the came and the electric current to operate any lighting system therein installed. SECTION &. For the purpose of carrying into effect this Ordinance, the Hoard of County Comnissioner shall annually, et the time required b7 general budgetary law, cake an itemized estimate of the amount of money required :o carry out the business of the District for the next fiscal year, which shall be from October to and including September 30 following. The estimate shall have for what purpose the monies are required and the amount necessary to be raised by taxation within the Unit. At the time and place for fixing the annual rate of taxation for County purposes, the Board shall fix and cause to be levied on all property within the Unit subject to taxation, a millage sufficient to meet the requirements of the estimate; provided, however, the total millage shall not exceed the millage authorized by lay for municipal service taxing or benefit unite. SECTION 5. Taxes herein provided for shall be assessed and collected in the same manner and form as provided for the assessment and collection of general County taxes and subject to the same fees for assessing and collecting aa general County taxes. SECTIO~ 6. This Ordinnnce shal! be liberally construed to effectuate its public purpose. If any portion, phrase or ~ord of this Ordinance is held invalid or unconsti- tutional, the remaining parts shall not be affected. SECTION 7. This Ordinance shall become e~fect{ve as provided by ENACTED HY THE BOARD OF COUNTY COF~ISSIONERS OF COLLIER COUNTY. FLORIDA this 7th day of February , 1984.
