BE IT ORDAINED by the Board of County Commissioners of Collier County, Florida, AND BE IT RESOLVED by the Board of County Commissioners of Collier County, Florida, Ex-Officio the Governing Board of the Marco Water and Sewer District that: SECTION 1. APPLICABILITY. This Ordinance shall apply to all connections to any sewer system within the Marco Water and S~ewer District. No residence, business or institution shall be exempt from this Ordinance. SECTION 2. DEPOSIT AMOUNT. A deposit amount, based on the type of connection, is hereby adopted by the District as follows: 1) ~ESIDENTIAL Single family residences only. COMME/RCIA~ 40.00 3) Any commercial, industrial and institutional enterprise, including but not limited to sanitarium, domiciliary houses, resident school, hotels, motels, apartment houses, condominiums, rooming houses, offices, stores, restaurants, warehouses, repair shops, churches, schools and other facilities which hold themselves out to the public as places of business. No person shall receive sewer service from the District until such person has made application for service and paid all fees due prior to connection to District facilities, including the deposit specified above. Failure to pay a sewer service bill when due shall result in the deposit being applied to the outstanding balance due for such service in addition to all other remedies provided by law. 81C0.00 SECTION 3. DEPOSIT REF/]NDS. Deposits shall be refunded on.[y upon transfer of the connected property from one o~ner to another owner. TY,,e County reserves the right to deduct any final billing or any accrued indebtedness from said deposit, and the balance, if any, shall be refunded to the depositor. Each residence or place of business shall be considered a separate service, and a deposit shall be required [or each separate service. SECTION 4. COMFLiCT AND SEVERABILiTY. In the event this Ordinance conflicts with any other 0rainance of Collier County, Florida, or any other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdicti¢.n, s~:zh portion shall be deemed a separate distinct and independent provision an~ such holding shall not effect the validity of the remaininq portion. SECTION 5. EFFECTIVE DATE. This Ordinance shall ta~e ~ff. ect upon r.~ceipt of notice that it has been filed with the Secretary of State.
