AN ORDINANCE REPEALING ORDINANCE NO. 83-18
AND ORDINANCE NO. 84-20 WHICH RELATED TO
THE REGULATION OF PRIVATELY-OWNED WATER AND
SEWER UTILITY SYSTEMS AND ESTABLISHED THE
COLLIER COUNTY UTILITY RATE & REGULATION
BOARD; PROVIDING FOR CONFLICT AND SEVER-
ABILITY; PROVIDING AN EFFECTIVE DATE.
WHEREAS, on April 16, 198~, the Board of County
Commissioners adopted Resolution No. 85-104, pursuant to Section
367.171, Florida Statutes, transferring regulatory jurisdiction
over privately-owned water and sewer utility systems to the
Florida Public Service Commission; and
WHEREAS, as a result of said Resolution the powers and
authc.rities contained in Ordinance Nos. 83-18 and 84-20 have been
transferred to the Florida Public Service Commission.
NOW THEREFORE BE IT ORDAINED BY T~E BOARD OF COUNTY
COM/4ISSIONERS OF COLLIER COUNTY, FLORIDA:
Section One: Ordinance Nos. 83-18 and 84-20 Repealed.
Ordinance No. 83-18 and Ordinance No. 84-20 which related to
the regulation of privately-owned water and sewer utility systems
and established the Collier County Utility Rate & Regulation
Board are hereby repealed in their entirety.
Section Two: Conflict and Severability.
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
Section Three: Effective Date.
This Ordinance shall become effective upon receipt of notice

with the Secretary of State.
