~ ~HERE~', the Board of County Commissioners has enacted
Ordinance No. 85-55, 'a~ ordinance establishing road impact fees
for Collier County; and
WHEREAS, Ordinance No. 85-55, Section Eight (B)(5) prevides
that the issuance of an occupancy certificate shall constitute
"commencement of land development activity" except where the
occupancy certificate is for a structure for which a building
permit was applied for prior to June 20, 1984; and
WHEREAS, it is the intent of the Board of County Commis-
sioners to exempt from the designation of "commencement of land
development activity" any occupancy certificate fox a structure
for which a completed building permit application was filed with
the County Building Department prior to October 1, 1985;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMIS-
SIONERS OF COLLIER COUNTY, FLORIDA that~

B. The "commencement of land development activity"
occurs upon any of the following events~
(1) the grant by the Board of County
Commissioners of a rezone or other zoning amendment at the
request of the property o~ner or the agent of the owner;
(2} the issuance by the Director of the Zoning
Department of any site development plan approval;

(3} the approval by the Board of County
".:,Commissioners of any subdivision master plan or preliminary or

" (4} ~ the issuance of any permit to authorize

(5) the issuance of an oocupanoy certificate in
regard to any structure on fha property, but not including any
oocupanoy certificate for a structure for which a completed

or
(6) the commencement of any building activity or
the making of any material change in the use or appearance of any
structure of land.

SECTION TWO: DECLARATION OF EMERGENCY.
This Board does hereby declare that an emergency exists and
that immediate enactment of this Ordinance is necessary, and by
no less than four-fifths (4/5the} vote of the membership of the
Board does hereby waive notice of intent to consider this
Ordinance.
A certified copy of this Ordinance, as enacted, shall be
filed by the Clerk of the Board with the Department of State of
the State of Florida, as soon after enactment as is practicable
by depositing the same with the postal authorities of the
Government of the United States ~or special delivery by
registered mail, postage prepaid, to the Florida Department of
State.
SECTION THREE: EFFECTIVE DATE.
This Ordinance shall be deemed to be filed and shall take
effect when a copy has bepn accepted by the postal authorities of
the Government of the United States for special delivery by
registered mail to the Florida Department of State.
