AN ORDINANCE CREATING THE RURAL LANDS
ASSESSMENT AREA OVERSIGHT COMMITTEE;
PROVIDING FOR CREATION AND PURPOSE;
PROVIDING FUNCTIONS, POWERS AND DUTIES;
PROVIDING FOR APPOINTMENT, COMPOSITION,
TERM OF OFFICE, ATTENDANCE AND FILLING OF
VACANCIES; PROVIDING FOR OFFICERS, QUORUM
AND RULES OF PROCEDURE; PROVIDING FOR
DISSSOLUTION OF THE COMMITTEE AND REPEAL OF
THIS ORDINANCE; PROVIDING FOR CONFLICT AND
SEVERABILITY; PROVIDING FOR INCLUSION IN CODE
OF LAWS AND ORDINANCES; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Collier County is required by the State of Florida Administration Commission,
pursuant to the Final Order of Case No. AC-99-002, to conduct an assessment of the rural and
agricultural area of Collier County, including: ali lands designated Agricultural/Rural; the Big
Cypress Area of Critical State Concern; ali conservation lands outside the County's urban
boundary; and Southern Golden Gate Estates; and
WHEREAS, the Final Order states that the Assessment shall be a collaborative, community-
based effort with full and broad public participation; and
WI-I~REAS, the Final Order encourages the County to consider the appropriateness of
undertaking the assessment in phases designed to address short-term as well as long-term
community needs and geographical differences; and
WHEREAS, the Final Order states that all plan amendments necessary to implement the
findings and results of the Assessment, or any phase thereo~ shall be effective not iat~r~an '~ne
22, 2002; and
WHEREAS, on August 3, 1999, the Board of County Commissioners agreed to
bifurcated analysis of the assessment area, with one process focusing on area designated the,-,.
"Rural Lands" area; and
WHEREAS, on August 3, 1999 and September 14, 1999, the Board elected to c~a~-~
citizens committee to oversee the assessment and development of comprehensive plan
amendments for the designated Rural Lands area; and
WHEREAS, by Resolution No. 99-364, dated September 14, 1999, the Board of County
Commissioners appointed members to the Rural Lands Assessment Area Oversight Committee.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
SECTION ONE: Creation and Purpose of the Rural Lands Assessment Area Oversight
Committee.
There is hereby created and established the Rural Lands Assessment Area Oversight
Committee, hereinafter referred to as "the Committee." The Committee is created to conduct an
assessment of portions of the rural and agricultural area of Collier County. The Board of County
Commissioners elected to create two committees to oversee the assessment and development of
comprehensive plan amendments pursuant to the State of Florida Administration Commission's
Final Order of Case No. AC-99-002, one committee to be established for the rural fringe
designated area and the other for the rural lands designated area. That portion designated as the
rural lands assessment study area is reflected on the map attached hereto as Exhibit "A."
SECTION TWO: Functions, Powers and Duties of the Committee.
The functions, powers and duties of the Committee shall be as follows:
1. The Committee shall hold public workshops for community input to assess community
needs and geographical differences, which will aid the Board of County Commissioners in their
adoption of comprehensive plan amendments for the geographical area designated as the rural
lands assessment study area.
2. The Committee shall report to the Board of County Commissioners short and long-term
goals benefiting the designated rural lands geographical area.
SECTION THREE; Appointment; Composition; Terms of Office; Attendance; and Filling
Vacancies.
1. The Committee shall consist of fifteen (15) members chosen by the Board of County
'Commissioners. In accordance with the parameters set forth in the Final Order No. AC-99-002
of the Administration Commission, "participation must be wide in scope with broad community
input." Therefore, the Committee members shall represent a cross-section of the public and
include some members with technical and scientific experience and analytical skills.
2. It is anticipated that the entire assessment process shall be concluded within
approximately 20-30 months fi'om creation of the Committee; however, the Committee may
conclude its work within a shorter timeframe. Upon appointment, the Committee shall serve the
entire term. Said term shall expire at the conclusion of the Committee's report to the Board of
County Commissioners.
3. Committee member attendance requirements, including failure to attend meetings and
removal from office are governed by Collier County Ordinance No. 86-41, as amended, or by its
successor ordinance. If a vacancy occurs on this Committee, a notice of vacancy shall be
publicized and prospective members sought through newspaper advertisement.
SECTION FOUR: Officers, Quorum; Rules of Procedure;
1. At its first meeting, the Committee shall elect a Chairman and Vice Chairman from
among the members. Officers' terms shall be for one (1) year, with eligibility for re-election.
2. The presence of a majority of the members shall constitute a quorum necessary to take
action and transact business.
3. The Committee shall, by a majority vote of the entire membership, adopt rules of
procedure for the transaction of business and shall keep a written record of m~tings, resolutions,
findings and determinations. Copies of all Committee minutes, resolutions, reports, and exhibits
shall be submitted to the Board of County Commissioners.
~ECTION FIVE: Dissolution of Committee; Repeal of Ordinance.
At the conclusion of the Committee's report to the Board of County Commissioners, the
objective of the Committee shall have been fulfilled. The Committee shall thereafter dissolve
itself and this Ordinance automatically repealed. Dissolution and repeal shall not be later than
December 31, 2002.

SECTION SIX: Conflict and Severability.
In the event this Ordinance conflicts with any other ordinance of Collier County or other
applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held
invalid or unconstitutional by any court of competent jurisdiction, ~uch portion §hall be deemed a
separate, distinct and independent provision and such holding shall not affect lhe validity of the
remaining portion.
SECTION SEVEN: Inclusion in the Code of Laws and Ordinance.
The provisions of this Ordinance shall become and be made a part of the Code of Laws and
Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or
relettered to accomplish such, and the word "ordinance" may be changed to "section," "article"
or any other appropriate word.
SECTION EIGHT: Effective Date.
This Ordinance shall be effective upon filing with the Florida Department of State.
