Ordinance 85-31 ORDINANCE NO. 85- AN ORDINANCE ESTABLISHING THE GOLLIER COUNTY WATER POLLUTION CONTROL PROGRAM AND PROVIDiNG- FOR ITS PURPOSES AND IMPLEMENTATION; PROVt DING FOR ITS FUNDING BY A ONE-TENTH (1/10) MILL TAX LEVY! PROVIDING FOR SEVEP2%B~ITY~ PROVIDING FOR CONFLICT! AND pROV~DINGf'~A~Atl EFFECTIVE DATE. WHEREAS, on November 6, 1984, the electors ;'10u~fO~ollier''- County, voting in a county-wide referendum, approved the levy & one-tenth (1/10) mill tax for the purpose of establishing water pollution control program; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA~ Section One~ Establishment of Collier County Water Pollution Control Program; Purposes and Implementation. There is hereby established the Collier County Water Pollution Control Program (hereinafter referred to as the "Program"). The Program is established for the purposes of developing a county-wide water pollution control program to monitor and study the treatment and disposal of sewage, and to abate the effects that the disposal of the resulting liquid and solid pollutants has o. the water resources o~ Collier County, Florida. The Board of County Commissioners of Collier County, Florida shall take all necessary and desirable actions to implement the purposes of the Program. Section Two, Funding and Levy of Taxes. The monitoring, study and abatement program designated pursuant to Section One of this Ordinance shall be provided from taxes levied in both incorporated and unincorporated areas of Collier County. The levy of one-tenth (1/10) mill which was approved in a county-wide referendum on November 6, 1984, shall be for the purposes specified in Section One of this Ordinance. The Water Pollution Control Program tax shall be ~evie~and collected at the same time and in the same manner as p~vide y law for othor County taxes. The Property Appraiser and the Tax Collector of Collier County, Florida are specifically authorized and directed to take all necessary and desirable action in furtherance of this Section Two. Section Three~ Severability. In the event that any word, clause, phrase, sentence, or paragraph hereof shall be held invalid by any Court of competent Jurisdiction, such holdings shall not effect any other word, clause, phrase, sentence, or paragraph hereof. Section Four: Conflict. Ail resolutions, ordinances, or other actions taken by this Board in conflict or inconsistent herewith are hereby repealed insofar as there is conflict or inconsistency.
