WHEREAS, the Board of County Commissioners a~.mpted Ordinance No. 86-34 creating the Lely Golf Estates Beautification Municipal Service Taxing Unit; and WHEREAS, the Board of County Commissioners adopted Reso- lution No. 86-118 calling a referendum election to approve the levy of taxes for the Lely Golf Estates Beautification Municipal Service Taxing Unit; and WHEREAS, there is a need to amend Ordinance No. 86-34 to provide for the correct description of the boundaries of the Lely Golf Estates Beautification Municipal Service Taxing Unit; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: Amended Boundaries Section One of Ordinance No. 86-34 is amended as follows: Section One: Lely Golf Estates Beautification Municipal Service Taxing Unit Created, Boundaries, Purposes, Taxing Authority. 1. The Unit hereby created and established is for the purposes of beautifying and maintaining the median ~trips of streets and certain other public areas within the Unit as determined by the Advisory Committee. Said Unit shall have the authority to levy ad valorem taxes as prescribed by law not to exceed one-quarter (1/4) mill in any one fiscal year, provided that the qualified electors residing in the Unit approve said levy in a referendum election. SECTION TWO: Construction and Severability. 1. This Ordinance shall be liberally construed to effec- tuate its public purpose. 2. It is declared to be the intent of the Board of County Commissioners that if any section, subsection, sentence, clause, phrase or provision of this Ordinance is held invalid or uncon- stitutional, such invalidation or unconstitutionality shall not be so construed as to render invalid or unconstitutional the remaining provisions of this Ordinance. SECTION THREE: Effective Date. The Board of County Commissioners does hereby declare that an eme~ncy exists and that immediate enactment of this Ordinance is necessary, and-by no less than four-fifths (4/Sths) vote of the membership of the Board does hereby waive notice of intent to consider this Ordinance. A certified copy of this Ordinance, as enacted, shall be filed by the Clerk of the Board with the Department of State of the State of Florida, as soon after enactment as is practicable by d~positing the same with the postal authorities of the government of the United States for special delivery by certified mail, po~tage prepaid, to the Florida Department of State.
