BE IT ORDAINED BY THE BOARD OF COUNTY CO~MISSIONERS OF ·
COLLIER COUNTY, FLORIDA:
SECTION ONE: Creation Of The Public Vehicle Ad¥isor~.Committee.
There is hereby created pursuant to County Ordinance
No. 86-4 the Public Vehicle Advisory Committee, hereinafter
referred to as the "PVAC".
SECTION TWO: Co__q~position Of The PVAC.
The PVAC shall consist of five (5) members; Three (3)
members shall be holders of certificates of public convenience
and necessity to operate a motor vehicle for hire business and
two (2) members, shall be persons who are in no way affiliated or
associated with any holder of a certificate of public convenience
and necessity. Members of the PVAC shall be appointed by and
~erve at the pleasure of the Public Vehicle Board. Said members
shall be permanent residents and electors of Collier County.
Appointment of members to the PVAC shall be by resolution of'
the Public Vehicle Board, which resolution shall set forth the
date of appointment and term of office.
SECTION THRE~= Terms Of Office.
The initial terms of office of the PVAC shall be as follows~
(a) Three (3) members consisting of two .(2) members .who are
holders of a certificate of public convenience and necessity and
one (1) member not affiliated or associated with. any holde~ of a
certific~te of public convenience and necessity -shall be
appointed for a term of two (2} years.
(b) Two (2) members consisting of one (1) member who is a
holder of a certificate of public convenience necessity and one
(1) member not affiliated or associated with any holder of a
certificate of public convenience and necessity shall be
appointed for a term of three (3) years.
Thereafter, 6ach appointment or reappointment shall be for a
term of four (4) years.
A me~er of the PVAC may be reappointed by the Public
Vehicle Board for one (1} successive term, if there are no other
qualified applicants for the member's position. Appointments to
fill any vacancies on the PVAC shall be for the remainder of the
unexpired term of office.
SECTION FOUR: Removal From Office; Failure To Attend Meetings.
(a) Any member of the PVAC may be removed from.office by a
unanimous vote of the Public Vehicle Board.
(b) If any member of the PVAC fails to attend three (3}
consecutive PVAC meetings without a satisfactory excuse or if a
member is absent from more than one-half of the Board's meetings
in a given fiscal year, the PVAC shall declare the member's seat
to be vacant and the vacancy shall be filled by the Public
Vehicle Board.
SECTION FIVE: Officers; Quorum~ Rules of Procedure.
(a} At its earliest opportunity, the membership of the PVAC
shall elect a chairman and vice chairman from among the members.
Officers' terms shall be for one (1} year, with eligibility for
reelection.
(b) The presence of three (3) or more members shall'
constitute a quorum of the PVAC necessary to tak~ action and
transact business. In addition, an affirmative vote of three (3)
or more members shall be necessary in order to take official
action, regardless of whether three (3) or more members of the
PVAC are present at a meeting. ·
(c} The PVAC shall, by majority vote of the entire
membership, adopt rules of procedure for the transaction of
business and shall keep a record of meetings, r~solutions,
findings and determinations.
SECTION SIX: Reimbursement Of Expenses.
Members of the PVAC shall serve without compensation, but
shall be entitled to receive reimbursement for expenses
reasonably incurred in the performance of their duties upon
approval by the Public Vehicle Board.
SECTION SEVEN: Functionsr Powers And Duties Of The P%IAC.
The functions, powers and duties of the PVAC shall be as
follows:
1. To review and make recommendations to the P~;lic Vehicle
Board regardin~ applications for a certificate of public
convenience and necessity pursuant to the County's Ordinance
regulating motor vehicles for hire.
2. To review and make recommendations to the P~)lic Vonicle
Board regardin~ issues related to the motor vehicle for hire
business and regarding alleged violations of ~e County's
Ordinance regul.lting motor vehicles for hire.
SECTION EIGHT: Conflict And Severability.
In the eTent this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is h.~ld invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION NINE~ ~ffective Date.
This Ordinance shall become effective upon receipt of notice
from the Secre~:ary of State that this Ordinance has been filed
with the Secre~ry' of State.
