ORIDA, BY AMENDING THE OFFICIAL ZONING ATLAS MAP NUMMER 49-25-5, BY CHANGING THE ZOUING CLASSIFICATION OF THE HEREIN DESCRIBED }'ROPERI'f LOCATED ON THE SOUTIi SIDE OF CASTELLO DRIVE APPROXIMATELY 200 FEET EAST OF US-41 IN SECTION 15, TOWNSHIP 49 SOUTH, RANGE 25 EAST, FROM C-I TO C-3; AND BY PROVIDING FOR AN EFYECTIVE DATE. WHEREAS, Forsythe, Humphrey and Associates, representing Dr. Ronald H. Stanhke, petitioned the Board of County Commissioners to change Zoning Classification of the hereinafter described real property; NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE: The Zoning Classification of the herein described real property is changed from C-1 to C-3 and the Official Zoning Atlas Map Number 49-25-5, ss described in Ordinsuce 82-2 is hereby amended accordingly: (see attached legal description) SECTION T~O: This Ordinance shall become effective upon notice that it has been. received by the Office of the Secretary of State. I, John Geshay, as owner or authorized agent for Petitions R-86-2C and PU-86-5C, agree to the following stipulations requested by the Collier County Planning Commission in their public hearing on biay 1, 1986. A site clearing plan shall be submitted to the Natural Resources Management Department and the Community Development Division for their review and approval prior to any substantial work on the site. This plan m~y be submitted in phases t~ coincide with tbs develop- ment schedule. The site clearing plan shall clearly depict how the final site layou, incorporates retained native vegetation to the maximum extent po~aibla and how roads, buildings, lakes, parking lots, and other f~cilities have been oriented to accommodate this goal. Native species sh~ll be utilized, where available, to the maximum extent possible in the site landscaping design. A landscaping plan will be submitted to the Natural Resources ltanagement Department and the Community Development Division for their review and approval. This plan will depict the incorporation of native species and their mix ~ith other species, if any. The goal of site landscaping shell be the re-creation of native vegetation and habitat characteristias lost on the sits during construction or d,~e to past activities. All exotic plants, as defined in the County Code, shall be removed during each phase of construction from development areas, open space areas, and preserve areas. Following site development a maintenance program shall be implemented to prevent reinvasion of the site by such exotic species. This plan, which will describe control techniques and inspection intervals, shall be filed with and approved by the Natural Resources Management Departnent and the Community Development Division. If during the course of site clearing, excavation, or other con- structional activities, an archaeological or historical site, artifact, or other indicator ia discovered, all development at that location shall ~e immediately stopped and the Natural Resources Management Dept,[ment notified. Development will be suspended for a sufficient length of time to enable the Natural Resources Management Department or a designated consultant to assess the find and determine the proper course of action in regard to its salvage- ability. The Natural Resources Management Department will respond to any such notification in a timely and efficient manner so as to provide only a minimal interruption to any constructional activi- ties. OF The large, unknown species of cactus be worked into the landscapin8 plan. Hecsures shall be taken to protect and preserve the fig trees located along Castello Drive. Detailed site drainage plans shall be submitted to the County Engineer for review. No construction permits shall be issued unless and until approval of the proposed construction in accordance with the submitted plans is granted by the County Enstneer. The entire 2.97 acre rezone parcel shall be brought into compliance with Collier County Water Management Criteria for a 3-year/i-hour storm event. The Petitioner will be required to submit all required data pursuant to Ordinance 80-112 regarding sewer service availability from the City of Naples at the time Building Fermit approval is requested from ~he Utilities Division. Any establishment requiring a CCPHU permit must submit plans for review and approval. There is presently a pi&cted (P.B.4, P.36) 20 feet alley which dead ends at the south property line and io centered approximately 260 feet east of the west property line. Zt would ,eem advantageous to have the alley extended to Castello Drive and the alignment could be designed to follow the proposed parking lot.
