Ordinance 87-091 RECEIVED ORDINANCE NO. 87- 91 AN ORDINANCE DECLARING THE ESTAB~,,~SHMENT OF A :' '- FAMILY MEDIATION OR CONCI~I~J%'~};~VICE TO BE FUNDS; PROVIDING FOR TH~-~L~S~E~ OF A SPECIAL COLLIER COUNTY FAMILY MEDIATION AND CONCILIATION FUND TO BE ADMINISTERED BY THE CLERK OF THE CIRCUIT COURT; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING AN 'EFFECTIVE DATE. WHEREAS, Chapter 44.101, Florida Statutes, provides that a family mediation or conciliation service is a valid public purpose and the Board of County Commissioners may support such a service by levying a service charge of no more than $2.00 on any circuit court proceeding in order to fund such service; and WHEREAS, the Board of County Commissioners of Collier County, Florida, finds it to be in the besC interest of the citizens of Collier County, Florida, to provide a family mediation or conciliation service to assist partie~ in resolving any controversy involving the family involving, but not limited to, marital problems, child abuse and related problems, spouse abuse and related problems, etc. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA: SECTION ONE. Purpose '~. The establishment and maintenance of a County family mediation or conciliation service in Collier County is hereby declared to be desirable and to fulfill a public need t~ assist parties in resolving any controversy involving the family. SECTION TWO. Source and Use of Funds There is hereby created a fund to be known as the Collier County Family Mediation/Conciliation Fund. Said fund shall be administered by the Clurk of the Circuit Court, and shall be used to provide services as directed by the court to any party in resolving problems involving the family. The courC on its own motion or on a motion of a party may refer the parties to this service. The Clerk of the Circuit Court of Collier County, Florida, pursuant tO Chapter 44.101, Florida Statutes, is hereby 1 authorized and directed to collect an additional fee of $2.00 for each and every circuit court civil proceeding filed within the Jurisdiction of the circuit court in and for Collier County, Florida. All such additional fees collected by the Clerk shall be deposited in the Collier County Family Mediation/Conciliation Fund established herein. The Clerk is further authorized and directed to draw warrants upon the Co'llier County Family Mediation/Conciliation Fund for all expenses incurred in carrying out the County family mediation/conciliation service when directed by the court, upon the submission to the Clerk of a requisition for same signed by the AdminiStrative Judge of the Circuit Court of Collier County, Florida. SECTION THREE. .Conflict and Severability In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION FOUR. Effective Date This Ordinance shall take effect upon receipt of notice from the Secretary of State that this Ordinance has been filed with ~'$..'~~.
