Ordinance 87-063 ORDINANCE NO. 87- 63 AN ORDINANCE REPEALING ORDINANCE NO. 84-80 WHICH ESTABLISHED REGULATIONS, PERMIT REQUIREMENTS, AND BOND REQUIREMENTS, RELATING TO AUCTIONS, AUCTION BUSINESSES, AND AUCTIONEERS; PROVIDING CONFLICT AND SEVERABILITY; PROVIDING AN EFFECTIVE DATE. WHEREAS, the Board of County Commissioners of Collier County, Florida, adopted Ordinance No. 84-80 on October 23, 1984 which established regulations, permit requirements, and bond requirements relating to auctions, auction businesses and auctioneers; and WHEREAS, Chapter 86-119, Laws of Florida, added Chapter 468, Part VI, Florida Statutes, which provides for State regulation ef auctioneers and auction businesses in the State of Florida and p~ohibits local governments from requiring any auctioneer's license in addition to the State license; and WHEREAS, the Board of County Commissioners finds that County Ordinance No. 84-80 has been superceded by State statutes. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA that: ~ SECTION ONE: Repeal of Ordinance No. 84-80 Collier County Ordinance No. 84-80 which established regulations, permit requirements, and bond requirements for auctions, auction businesses, and auctioneers is hereby repealed in its entirety. SECTION TWO: Conflict and Severabilit¥ In the event this Ordinance conflicts w.ith any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION THREE: Effective Date This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
