AN ORDINANCE AMENDING ORDINANCE 82-2, THE COMPREHEN-
SIVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA
OF COLLIER COUNTY BY AMENDING SECTION 8.44, RELATION
TO STATE ANF FEDERAL STATUTES, SUBMISSION OF APPLICATION
FOR DEVELOPMENT APPROVAL FOR DEVELOPMENT OF REGIONAL
IMPACT; AND BY PROVIDING AN EFFECTIVE DATE:
NOW, THEREFORE BE IT ORDAINED by the Board of County Commissioners of
Collier County, Florida:
SECTION ONE:
Section 8.44 of Ordinance 82-2, the Zoning Ordlnance of Collier
County, Florida is hereby amended to read as follows:
a. Required State and/or Federal Permits: Where
proposed use or development requires State or
Federal Permits prior to use or development,
such permits must be secured from State or -
Federal agencies prior to commencement of any-
construction and/or development, including
changes in land conformation or land preparation.
b. Development of Regional Impact: Where a propped
use or development is a Development of Regional
Impact, it shall meet all of the requirements of
Chapter 380.06 Florida Statutes.
Submission of the Application for Development
Approval (ADA) for a Development of Regional
Impact (DRI) shall be simultaneous with the
submission of any rezonin~ and/or provisional
use application or other land use related
petition required by County Ordinance to
allow for concurrent reviews and public
hearings before both the Planning Commission
and Board of County Commissioners of the ADA
snd rezone and/or provisional use applications.
The DRI and rezone and/or provisional use shall
be approved prior to the issuance of any required
County Permits and commencement of construction
or development.
