Ordinance 87-046 ORDINANCE NO. 87- 46 AN EMERGENCY ORDINANCE RE~'EALING EMERGENCY ORDINANCES NO. 87-28 AND 87-29 WHICH ESTABLISHED REGULATIONS GOVERNING THE USE OF THE C¢,LLIER COUNTY WATER SYSTEM FOR LAWN SPRINKLING WITHIN THE UNINCORPORATED AREAS OF COLLIER COUNTY; P~OVIDING CONFLICT AND SEVERABILITY; DECLARING THE EXISTENCE OF AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. ~o WHEREAS, the Board of County Commissioners of Co~?lier County, Florida, adopted Emergency Ordinance No. 87-28fon May 5, ~ 1987 which established regulations governing the use ~f the'" Collier County Water System for lawn sprinkling withir~the ~ unincorporated areas of Collier County, Florida; and WHEREAS, the Board of County Commissioners of Collier County, Florida, adopted an Emergency Ordinance No. 87-29 on May 5, 1987 amending Emergency Ordinance No. 87-28 to provide that the regulations governing the use of the County Water System for lawn sprinkling are established within a designated portion of the unincorporated area and are implemented within said portion of the unincorporated area of Collier County, Florida; and WHEREAS, the Board of County Commissioners finds that the mandatory lawn sprinkling regulations are no longer require~ within unincorporated areas served by the Collier County Water System; and WHEREAS, the Board finds it appropriate and necessary to discontinue lawn sprinkling restrictions as a result of increased rainfall and further finds that emergency enactment of this ordinance is necessary to limit inconvenience and/or hardship to residents of the County; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER CUUNTY, FLURIDA, that: SECTION ONE: Repeal of Emergency Ordinances No. 87-28 and 87-29 Collier County Emergency Ordinances No. 87-28 and 87-29 which established regulations governing the use of the Collier County Water System for lawn sprinkling within portions of the unincorporated areas of Collier County are hereby repealed in their entirety. SECTION TWO: Conflict and Severability In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION THREE: Declaration of Emergency; Effective Date This Board does hereby declare that an emergency exists and that immediate enactment of this Ordinance is necessary, and by no less than four-fifths (4/5thc) vote of the membership of the Board does hereby waive notice of intent to consider this Ordinance. A certified copy of this Ordinance, as enacted, shall be filed by the Clerk of the Board with the Department of State of the State of Florida, as soon after enactment as is practicable by depositing the same with the postal authorities of the government of the United States for special delivery by registered mail, postage prepaid, to the Florida Department of State. This Ordinance shall become effective as provided in Section 125.66(3), Florida Statutes.
