AN ORDINANCE REPEALING ORDINANCE NO.
77-33 WHICH CREATED THE IMMOKALEE
WATER AND SEWER DISTRICT; PROVIDING FOR
CONFLICT AND SEVERABILITY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Collier
County, Florida, adopted Ordinance No. 77-33 on June 21, 1977
creating the Immokalee Water and Sewer District as a special
purpose district pursuant to Chapter 125 and Chapter 153, Part
II, Florida Statutes; and
WHEREAS, Special Act 78-494, Laws of Florida, created the
Immokalee Water and Sewer District as an Independent District;
and
WHEREAS, the Dependent District created by County Ordinance
No. 77-33 is as a consequence no longer applicable or necessary;
and
WHEREAS, the Board of County Commissioners finds i~ --~

County to repeal Ordinance No. 77-33. Il ~'
NOW, THEREFORE, BE IT ORDAINED BY TH~ BOARD OF CO~Y ~!
COMMISSICNERS OF COLLIER CO~, FLORIDA that: ~ ~
SECTION ONE: Repeal of Ordinance No. 77-33
Collier County Ordinance No. 77-33 which established the
Immokalee Water and Sewer District as a special purpose district
under Chapter 125, and Chapter 153, Part II, Florida Statutes,
is hereby repealed in its entirety.
SECTION TWO: Conflict and Severability
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of 'the remaining portion.
SECTION THREE: Effective Date
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
