Ordinance 87-001AN ORDINANCE AMENDING ORDINANCE 77-18, WHICH ESTABLISHED THE PELICAN BAY PLANNED UNIT DEVELOP- MENT, TO REFLECT THAT THE MAIN ROAD THROUGH THAT AREA OF THE PUD BOUNDED BY PELICAN BAY BOULEVARD ON THE NORTH, U.S. 41 ON THE EAST, THE NORTH BOUNDARY OF PELICAN BAY UNIT FIVE ON THE SOUTH, AND THE CLUB AT PELICAN BAY GOLF COURSE ON THE WEST IS INTENDED TO BE PUBLIC; REPEALING ORDINANCE NUMBER 83-48, WHICH ESTABLISHED THIS ROADWAY AS PRIVATE; AND BY PROVIDING AN EFFECTIVE DATE. WHEREAS, on April 19, 1977, the Board of County Commissioners approved Ordinance Number 77-18, which established the Pelican Bay Planned Unit Development; and WHEREAS, on September 20, 1983, the Board of County Commissioners approved Ordinance 83-68, which nmended the Pelican Bay PUD by changing the main road through that area of the PUD bounded by Pelican Bay Boulevard on the north, U.S. 41 on the east, the north boundary of Pelican Bay-~nit Five on the south, and The Club at Pelican Bay golf course on the west, from a public roadway to a private roadway; and WHEREAS, Westinghouse Communities of Naples, Inc., (formerly known as Coral Ridge-Collier Properties, Inc.), petitioned the Board of County Commissioners of Collier County to repeal Ordinance Number 83-48, and designate this roadway as public; and WHEREAS, adoption of this ordinance will not result in and does not constitute a substantial deviation from the Development Order for Pelican Bay adopted by the Board of County Commissioners of Collier County pursuant to Chapter 380, Florida Statutes] NOW, THEREFOREBE IT ORDAINED by the Board of County Co~m~issioners of Collier County, Florida: SECTION ONE: Collier County Ordinance Number 83-48 ia hereby repealed; thereby designating the roadway which is bounded by Pelican Bay Boulevard on the north, US-41 on the east, the north boundary of Pelican Bay Unit Five on the south, and the Club at Pelican Bay Golf Course on the west, as a public roadway. SECTION TWO: This Ordinance shall become effectfve upon notice that it has been receive4 by the Office of the Secretary of State.
