PROVIDING FOR PURPOSE AND POWERS! PROVIDING FOR ANNUAL ESTIMATES OF EXPENSES AND TAXATION RATE! PROVIDING FOR TAX ASSESSMENT AND COLLECTION~ PROVIDING FOR CONSTRUCTION~ DECLARING AN EMERGENCY~ AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY TIlE BOARD OF COUNTY COMMISSIONER~ OF COLLIER COUNTY, FLORIDAs Section Onet Street Lighting Municipal Service Taxin~ Unit Created! Boundaries. Pursuant to Chapter 125 of the Florida Statutes, the Noon Lake Units I & 2 Street Lighting Municipal Bervice Taxing Onit is hereby created for the purpose o£ providing street lighting to the residents of the taxing unit, the boundaries of which are hereinafter described= All of Moon Lake Unit 1 as recorded in Plat Book 14, Pages 103-106, inclusive, of the Public Records of Collier County, Florida; all being a part of the West 1/2 of the Southeast 1/4 of Section 6, Township 50 South, Range 26 East, Collier County, Florida, containing 23.50 acres more or less~ and All of Moon Lake Unit 2 as recorded in Plat Book 14, Pages 122-123, inclusive, of the Public Records of Collier County, Floridal all being a part of Section 6, Township ~0 South, Range 26 East, Collier County, Florida. Section Twos Governing Bod~. The governing body of the Unit shall be ex-officio of County Commissioners of Collier County, Florida. Section Threes Pur~ose~ Powers. The Unit is formed for the purpose of providing lighting in the above-described st~lvision and ~o ~hat possess all the powers to do all things reasonably necessary to provide such services, including ownership or rental o£ property, poles, wires, conduits, lights, meters, and the pc~er to ~aintain the same and to enter into contracts for providing the same and the electric current to operate any lighting system therein installed. Section Pours Annual Estimates of Ex~enses! Taxation Rate. For the purpose of implementing this Ordinance, the Board of County Cmmaissioners shall annually, at the time required by general budgetary law, make an itemized estimate of the amount o£ ~oney required to carry out the business of the Unit for the next £1lcal year, which shall be from October ! to and including September 30 following. The estimate shall have for what purpose the moneys are required and the amount necessary to be raised by taxation within the Unit. At the time and place for fixing the annual rate of taxation for County purposes, the Board shall fix and cause to be levied on all property within the Unit sub~ect to taxation a millage sufficient to meet the requirements of the estimate! provided, however, the total millage shall not exceed the millage authorized by Law for municipal service taxing or benefit units. ~ection Five: Tax Assessment and Collection. Taxes herein provided for shall be assessed and collected in the same ~anner and form as provided for the esses~nt and collection of general County taxes and subject to the aa~ £eea for assessing and collecting ae general County taxes. Bection Six: Construction. This Ordinance shall be l~berally construed to its public purpose. Section Seven: Declaration of Z~er~enC~o · his Board does hereby declare that an e~ergency uistl and that :Immediate enactment of this Ordinance is necessary, and by no less than four-fifths (4/Sths) vote of the mm~bership o£ the Board does hereby waive notice of intent to consider this O~dinance. ~ection Eight: Effective Date. A certified copy o£ this Ordinance, as enacted, shall be filed b~ the Clerk of the Board with the Department o£ Btat~ o£ the State of Florida, as soon after enactment as ia practicable by depositing the same with the postal authorities o£ the government of the United States £or special delive~ by registered mail, postage prepaid, to the Florida Department of State, ., /:.:-..I:~T]~=.. t:~cembar 20, 1988 .
