BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA~
Section One: Street Lightin~ Municipal Service Taxin~
Unit Created~ ~oundaries.
Pursuant to Chapter 125 of the Florida Statutes, the
Sabal Lake Unit 1 Street Lighting Municipal Service Taxing Unit
is hereby created for the purpose of providing street lighting to
~he residents of the taxing unit, the boundaries of which are
hereinafter described ~
All of Sabal Lake Unit I as recorded in Plat Book~ ~
Page. 1-2, lnclusiv., of th. Public Record. of Co1~ ~4
County, Florida; all being a part of Section 4, T~.~
· hip South. Rang. Es.t, Colli.r County, ,lori
containing 42.94 acres ~ore or less. ~o ~ ~
Section Two~ Governing Body. o~ "
The governing body of the Unit shall be ex-officio t~oa~d
of County Commissioners of Collier County, Florida.
Section Three~ Pur~ose[ Powers.
The Unit is formed for the purpose of providing street
lighting in the above-described subdivision and to that end shall
possess all the powers to do all things reasonably necessaL~ to
provide such services, including ownership or rental of property,
poles, wires, conduits, lights, meters, and the power to ~ntain
the same and to enter into contracts for providing the same and
the electric current to operate any lighting system therein
installed.
Section Four~ Annual Estimates of Expenses! Taxation Rate.
For the purpose of implementing this Ordinance, the Boagd of
County Commissioners shall annually, at the time require~ by
general budgetary law, make an itemized estimate o£ the amount o£
· oney required to carry out the business of the Unit £or the next
fiscal year, which shall be fro~ October ! to and including
September 30 following. The estimate shall have for what purpose
the moneys are required and the amount necessary to be raised by
taxation within the Unit. At the tJ~ae and place for fixing ~he
at, ual rate of taxation for County purposes, the Board shall fl
and cause to be levied on all property within the Unit subject to
~axation a millage sufficient to meet the requirements of the
estimate; provided, however, the total millage shall not exceed
~he ~llage authorized by law for municipal service taxing o=
benefit units.
~ection Five~ Tax Assessment and Collectio~.
Taxes herein provided for shall be assessed and collected in
the same manner and form as provided for the assessment and
collection of general County taxes and subject to the same fees
for assessing and collecting as general County taxes.
Section Sixt Construction.
This Ordinance shall be Liberally construed to ef£ecttta~e
its public purpose.
Section Seven~ Declaration of,Emergency.
This Board does hereby declare that an e~ergency exists and
that insaediate enactment of this Ordinance ia necessa~, and by
no less than four-fifths (4/Sths) vote of the mmabership of the
Board does hereby waive notice of intent to consider this
Ordinance.
Section Eiqht~ Effective Date.
A certified copy of this Ordinance~ aa enacted, shall be
filed by the Clerk of the Board with the Department of State of
the State of Florida, as soon after enactment as is practicable
by depositing the same with the postal authorities of the
government of the United States for special delivery by
registered mail, postage prepaid, to the Florida Department of
This Ordinance shall become effective aa provided in Section
i25,65(3), Florida Statutes.
