Ordinance 88-098regulate excavations within Collier County, Floridal and
WHEREAS, the creation of the Development Services Department
administratively modifies the authority for decision making with
respect to Ordinance Ho. 88-26; and
WHEREAS, the Develo~ent Services Department and the County
Engineer's roles In the adminlstrattcn of the Kxcavatlon
Ordinance must be clearly defined.

SECTION ONE:
Section 4, Paragraph D of Collier County Ordinance No. 88-26
hereby amended to read as

SECTION TW~:
Section 4 of the Collier County Ordinance No. 88-26
hereby amended to add Paragraph G which shall read as £ollo~lt
"County Engineer" shall mean the County gnoineet of
Collier County or his duly authorized rep~q~entat~ve.
SECTION THREEs Conflict and Severability
In the event this ordinance conflicts with any other
ordinance o£ Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of the
ordinance Is held invalid or unconstitutional by any court o£
competent Jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
a££ect the validity of the remaining portion.
