WHI~EAS, the Board of County Commissioners of Collier County, Florida, established the Collier County Free Public Library and the Governor of the State of Florida appointed five (5) members to serve on the Library Board in September, 1957~ and WHEREAS, Chapter 71-14, Laws of Florida, provides that the Library Board be appointed by the Board of County and WHEREAS, in January, 1973, the Board of County appointed the members of ~ho Library Board~ WHEREAS, County Ordinance No. 86-41 established for creation and review of county advisory boards. NO~, THEREFORE, BE IT ORDAINED BY T}~ BOARD OF COUNTY C~4MISSIONERS OF COLLIER COUNTY, FLORIDA, that~ SECTION ONE. Confirm the creation of the L~bra~y' AdviSory ~oaFd This ordknance is enacted pursuant to Ordinance No. 86-41 to confirm the creation of the Library Advisory Board. SECTION TWO. Appoi. ntment and Compositi0~' a) The Library Advinory Board shall consist of five m~ers which represent the County Ccm~salon Districts. b) Members of the Library Advisory Board aha11 be al~9Ointed by and serve at the pleasure of the Bo&rd of County C~lssioners. Said members sh&ll be permanent residents and electors of Collier County. c) Appointment of members to the Library Advisory Board shall be by resolution of the Board o£ County Co~miesionera, which resolution shall set forth the date of eppointm~nt and the term of office. Initial appointments to the LLbrary Advisory Board shall be made from ~hose members presently serving on ~he L£b~ary Advisory Board upon the effective date of this ordinance. If for any reason there ia an insufficient number of members which to designate the ~'~bership of the Library Advisory Board, the Board of County Co~ulssionera shall request and accept applications fro~ the general public to co.plate the initial appo£ntment of e~ers to the Llbrary Adviaory Board. SECTION THREB, Terms of Offic~ The initial terms of office of the Library Advisory Board shall be as foll~wst a) Two (2} members will serve until December ]1, 1990. b) Three (3) members will serve until December 31, 1988. Ther(~after, each appointment or resppointment aha11 be for a term of four (4) years. A person shall not be considered to have served a full term of office unless that ~erson has served at least two (2) years. All terms of office shall expire on 31st day of December. A member of the Libra~7 Advisory Board may be reappointed the Board of County Co~issioners for one (1) successive term. However, other qualified applicants~aybe cor~idered fo= any vacancy. Appointments to fill any vaca~cies on the Advi,oryBoard shall be for the remainder of the tmexpl=ed of office. SECTION FOUR. Re~oval from Office~ Fa!lure to a) Any member of the hibraryAdvisoryBoardmaybe re~ved frc~ office by a majority vote of the Board of County Co~uission~rs. b) If any member of the Library Advisory Board £ails to attend two (2) consecutive Library Advisory Board meetings without a satisfactory excuse, or if a member is absent frc~nmore than one-half of the Library Advisory Board's meetings in a given year, the Library Advisory Board shall declare the member's to be vacant and the vacancy shall be filled by the Board of County Co~issionera. SECTION FIVE. O~ficers~ ~uorum~ Rules of Procedure a} Annually, at its first maeting~ the ~mberah£p o£ the Library Advisory Board shall elect a chairman and vice-chair~an from Being the members. Of£1cers' terms shall be for one {1) ye&r, with eligibility for reelection. ' b} The presence of three (3} or more members shall constitute a quorum of the Library Advisory Board necessary to take action and transact business. In addition, an affirmative vote of three (3) or more members shall be necessary in order to take official action, regardless of whether three (3) or more meml~rs of the Llbrary AdvtsoryBoard are present at a meeting. c) The library Advisory Board shall, by majority vote of t~.o entire membership, adopt rules of procedure for the transaction of business and shall keep · record of meetings, resolutions, findings and deters/nations. SECTION SiX. ~eim~u...rsement. 0f Expenses ~embera of the Library Advisory Board shall serve without compensation, but shall bm entitled to receive reimbursement for expenses reasonably Incurred in the performance of their duties upon prior approval of the Board of County Commissioners. SECTION SL%~N. Functionsr Powers and Dutlg~ 9~ the Library The functions, po~ers and duties o£ the Library Advisory Board shall be as follo~s= a) Act in an advisory capacity to the Board of County Commissioners in matters relating ~o library affairs. b) Review, investigate and study special problems relating to Library policies. c) Identify, study, evaluate, and provide recoem~ndations to the Board of County Commissioners on programs that will benefit the Collier County Library Syste~. d) Review and recon~nd to the Board of County C~e~issioners budget =ecoe~endations for the forthcoming fllCal year for the operation of the Collier County Library System. e) The Library Advisory Bo&rd may adopt and amend "~uiaelines and Bylaws# to govern the operation of the Library Advisory Board, subject to approval by the Board of County Cc~l~Slionerl, 298 3 Des£anee The duties of the County Libra=y Director or h~s a) ~niste~ the act~v~tiea o~ the L~b~a~ ~v~so~ ~ard ~n accordance w~th est~l~shed ~l~c~es o~ ~he Board of C~Iss~oners and ~delines and ~laws adopt~ ~ the ~v~o~ard. b) P~epa~e the annual ~dget In accordance w~th Section Seven, Paragraph d, ~ve. c) Provide ~rl~lc written =e~rt~ to the Llbra~ the Collier County Library System and its finances in accordance with established guidelines of the Board of County Commissioners or the Llbrary AdvisoryBoard. d) Attend all Llbrary Advisory Board ~etings. SECTION NINE. ~gvi~w ~rocess The Library Advisory Board shall be reviewed once ever~ four (4) years co~mencing with the year 1988, in accordance with the procedures outlined in Ordinance No. 86-41. SECTION TEN. Conflict and Severabilit¥ In the event this ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of the ordinance is held invalid or unconstitutional by any court of c~Btent Jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION K~. l~fective Date This ordinance shall become effective upon receipt of notice from the Secretary of State that this ordinance has been £11ed with the secretary of State.
