WHEREAS, the 1988 Florida Legislature has expanded the Pock~t of Poverty pilot program to include the unincorporated com~unity of Immokalee, purnuant to House Bill 1454! and WHEREAS, one purpose of the Pocket of Poverty pilot progra~ ia to create a partnership between the public and private sectors to stimulate hounin, g construction and rehabilitation! and WHER~S, the enabling legislation requires the appointment of a Pocket of Poverty Review Co~mittee for ..the purpose of ensuring that all activities as required by t~he legislation ara completed~ and WHEREAS, a Ca~praheneive Farmworker Housing Plan ~ust be prepared and~onitoring of program activi=les conducted. NOW, THEREFOre, BE IT ORDAINED BY THE BOARD OF COUNTY ¢O~ISSION~S OF COLLIER COUNTY, FLORIDA, that: SECTION ONE~ Creation of the Collier County Pocket of Povert~ Rev-~-f~ Committee~ Purpose. This Ordinance is enacte(~ uursuant the House Bill 1454, an act of the 1988 Florida Legislature and Ordinance No. 86-14, hereby creating the Collier County Pocket of Poverty R~view Committee (hereinaf'~er referred to as the Review Committee) for the purpose of preparing a local Comprehensive Farmworker Hot,sing Plan and program mo~litoring. SECTION T~0~ Appoirttment and Composition. The review Co~m~lttee shall consist of nine (9) members, with the ~aJority repres~nting the Co~unity of I~aokalee, Florida as described in House Bill 1454. The Review Committee shall include representation from the local public bo~y, as defln, Jd In House Bill 1454, and inclt~ding t:he Board of County Commissioner~ the local industry, farmworkern, community based operation/, bankers, dav. lopers, contractors and others interested in eztablishing ].o~-cost housing in ~he Xmz~kalee community. Xnitial solicitation for prospective members of the Review Coam~ittee shall be noticed in circulation within Collier County Libraries and County Courthouse. a publication o! g~neral and posted in the County Memb.ers of the Review, Committee shall be appointed by and serve at the pleasure of the Board of County Commissioners. Each member shall be a re~sident and el2ctor residing within Collier County, Florida. ~o parson shall be eligible to serve on the Review C~mmittee who has a financial, personal or representative interest in the funding of an eligible sponsors~ proposal. SECTION TIIREE= Term of Office. The ].nitial te~ of office of Review Committee members shall be for a ~ximum of t~ro (2) year~, however, in an~ event, &s long as responsibilities ¢)f such Committee exist pursuant to House B£11 1454. Should a vacancy occur, said vacancy shall be filled upon publication of a vacancy notice in a publication of ge.nora1 circulation within Collier County and Posted in the County Libraries and Count:~ Courthouse. All applications/rO.lU~S received by the Board of County Commissioners shall be forw.~rded to the Review Committ~e Chairman for review and discussion with other Review Committ~e men,ers. After due consideration, the Rsvie~w Committee Chairman shall recommend to the Board of County Commissioners a qualified individual to fill the vacant seat. Appointments to fill any va=ancies on the Review Committee ~lhall be for the remainder of the unexpired term of office. Should a member =e~ign prior t~ the completion of hi,l/her term of office, that me~)er should advise, in writing, the Committee Chairman and the ~oard of County Commissioners of luch resignation. SECTION FOUR~ Remova~ froz~ O~ficel Failure to Attend .~eetinqs. Any member o! 'the ~eview Committee may be removed from office by a majority vote of the Board of County Con~aissioners. If any me:tuber of the Revi(,w Committee fails to attend three (3) consecutive Revie~ ¢'.onunittee meetings without a satisfztctory excuse, or if a membem is absent for more than one-third (1/3) of the Review Committeo~s meetings in & given calendar year, the Review C~maittee shall declare the member's seat to be vacant and the vacancy shall be filled in accordance with this Ordinance by the Bo~ard of Count~.~ Commissioners. SECTION FIVE: Election o~ Officers~ ~uorum~ R~tles o! Procedure. A. At its earliest opportunity, the membership o~ the Review Committee shall elect a chairman and vice chairman from among the members. Officers' terms shall be for one (1) year, with eligibility for ::eelection. B. The presen.~e of five (5) or more members shall constitut~ a quor~ua .mr th.a Review Committee necessary to take action and transact bt:siness. '~ C. The Review Cc~mittee shall, by majority vote of the entire membership, adopt rules o~ procedure for the transaction of busin,~ss and shrill keep a written record of meetings, resolutions, findings and determinations. Copies of all Review Committee minutes, re,solutions, reports, and exhibits shall be submitted to the Board of County Commissioners'. SECTION SXX: Comp~n~tition. Mem~rs of the Review Committee shall serve without COml~ansation. SECTION SI,'VEN: I~c. at:[o~ of Meetings. Ail meetings o:[ the Review Committee shall be publio meetings. Meetings shall be held at the Collier County Government: Center Annex, Xmmokalee, Florida or at such other location(:s) aa the ~eview Conunittee may determine and provide public notice thereof as required by law. SECTION EIGHT: F,unct, ior, sf,,powers and Duties of the Review Committee. . The functions, powers and duties of the' Review Committee lihall be to provide public participation and co~unity input in the development and preparation of the Comprehensive Farmworker Housing Plan, participate in the application procedures, enter into grant agreement(s) with eligible sponsors, and monitor proJ(~ct status according to thu accountability provisions of any grant: agreement and as further defined, described and provid.ad in House Bill 1454. The Collier County Housing' and Urban Improvement Director shall act as staff liaiso~ to the R~view Conflict and Severabilit¥. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any couzt of competent jurisdiction, such portion shalX be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION TEN: Effective Date. · This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
