HHEREAS. the Utilities Rate Requlation Fund (Fund 405) had ? ./t.'
been established for the sole purpose of collectinq requlatory feel ;':.;
froa privately owned utilities and expendinq these tees in the ...~....~,.\y~~

WHEREAS, the Board no longer has the authority to requlate.
private utilities, and, therefore. the Fund (Fund 405) is no lonqe&'
active, and
WHEREAS, since this is an adminis~rative function and does not
relate directly to any other specific Utility Fund, it ia
considered proper to combine the remaininq fund balance with th~ .

WHEREAS, the legal aspects of transferring
balance have been discussed with, and confirmed
Attorney's office, and
the remaininq fund. "-1.. .., ~

WHEREAS, collections of all private utility requlatory feea
were current through the end of the first quarter (March 31. 1985).
and since the Public Service Commission assumed authority on April
16, 1985, the Board no lonqer has rate. requlation authority. it is
not considered necessary to collect any additional requlatory feea
froll private utilities for the period ot April 1, 1985 to April 15,
. 1985, because these fees would only be passed on to the usera and
would aerve no purpose to the Board, and
HHEREAS, since the transfer of authority to the Public Service
Co_i.sion took place a~ a point in time when the East Naples Hater
Systea. rate case was brought to a conclusion, and the final cost
of the County consultants was. not billed to East Naples Hater
Systeas, and
HHEREAS, the Fund (Fund 405) has already paid all outstanding
liabilities, and the billinq of this final cost would be passed on
to the customers and would serve no further benefit to the public
or the County, it is recommended this final cost not be billed to
East Naples Hater Systems.

dissolved.
b) All reaaininq balances of FUnd 405 shall be
transferred to the Utilities Administrative Fund
401) .
C) No additional requlatory fees shall be collected froa
private utilities for the period fro. April I, 1985 to
April 15, 1985.
d) The final cost of the County consultants shall
billed to East Naples Hater Systems.
This Resolution adopted after motion, second and roll call
