SBCOND AMBKDMBN'l' TO THB BBACH ACCBSS
FACILITIBS AGREEMENT BETWEEN COLLIBR COUNTY,
SHELTBR SBAGATB CORPORATION AND WESTINGHOUSB
COMMUNITIBS or NAPLES, INC.
WHEREAS, the parties desire to amend the Beach Acce.s
Facilities Agreement dated November 15, 1983, for the provision
of beach facilities at Clam Pass Park, an~

WHEREAS, environmental permits were to be obtained and
, construction was to begin on the boardwalk access system prior to,.,.,-
a certain date in order for Shelter Seagate Corporation to be
obligated to provide construction funds for the boardwalk access
system, and
WHEREAS, because of appeals filed by the Pelican Bay..

be extended until October 1, 1986, and
WHEREAS, this Second Amendment to the Betch Access

Facilities Agreement provides for extension of a~l time periods

for an additional six months up to and including October 1, 1986,
for the obtaining of p~rmits and commencement of construction..
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the Chairman of
the Board of County Commissioners i8 hereby authorized to execute
this Second Amendment to the Beach Access Facilities Agreement
dated November 15, 1983, between Shelter Seagate Corporation,
Collier County, and Westinghouse Communities of Naples, Inc., a
copy of which Amendment is Attached hereto And incorporated
herein.
