BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUI~'TY, FLORIDA: SECTION ONE: Repeal of Section Two of Ordinance 78-67, Section One of Ordinance 80-53, Section One of Ordinance 82-122, Section One of Ordinance 85-9, and Section One of Ordinance 86-29. Section Two of Ordinance 78-67, Section One of Ordinance 80-53, Section One of Ordinance 82-122, Section One of Ordinance 85-9, and Section One of Ordinance 86-29, all of which related to the boundaries of the Pelican Bay Lighting Municipal Service Taxing District are hereby repealed. SECTION TWO: New Boundaries of Pelican Bay Lighting Municipal Service Taxing Unit Established. The Ordinance Sections repealed above shall be replaced by this Section. The boundaries of the Pelican Bay Lighting Municipal Service Taxing Unit shall be as follows: All that fractional part of Section 32, lyin~ South of Vanderbilt Beach Road, and all of Section 33, lying South of Vanderbilt Beach Road and West of State Road 45 (U.S. 41); all in Township 48 South, Range 25 East; and alas all of Section 4, lying West of Stats Road 45 (U.S. 41); all fractional parts of Govezmaent lots I and 2, Section 5; all fractional parts of Section 8; and all of Segtion 9, lying West of State Road 45 (U.S. 41), excepting therefrom the South 70 feet of the Southeast one-quarter and the South 70 feet of the East 158.25 feet of the Southwest one-quarter; all in Township 49 South, Range 25 East, said lands situate, lying and being in Collier County, Florida. The boundaries of the District which includes said lands are: A tract of land being in portions of Sections 32 and 33, Township 48 South, Range 25 East; together with portions of Sections 4, 5, 8, and 9, Township 49 South, Range 25 East, Collier County, Florida, and being more particularly described as follows: Commencing at the Southeast corner of said Section 33; thence South 89 degrees 59 minutes 50 seconds West along the South line of said Section 33 a distance of 150.02 feat to a point on the West ri§hr-of-way line of State Road 45 (U.S. 41), said point also being the Point of Beginning; thence Southerly along the West right-of-way line of said State Road &5 (U.S. &l) the following courses: South 00 degrees 58 minutes 36 seconds East a distance of 2.49 feet; thence South 00 degrees 55 minutes 41 seconds East a distance of 3218.29 feet; thence South Ol ~egrees 00 minutes 29 seconds East a distance of 3218.~6 feet; thence South 00 degrees 59 minutes 03 seconds Eaac a distance of 2626.21 feet; thence South 01 degzees 00 minutes 18 seconds East a distance of 2555.75 feet to a point on the North right-of-way line of Pine Ridge Road as recorded in D.B. 50, Page 490, among the Public Records of said Collier County; thence departing said U.S. &l (State Road 45) South 89 degrees 09 minutes &5 seconds West along said North right-of-way line a distance of 2662.61 feet; thence South 00 degrees 51 minutes 14 seconds East a distance of 70.00 feet to a point on the North line of Seagate Unit One as recorded in Plat Book 3, Page 85 among said Public Records; thence South 89 degrees 09 minutes 45 seconds West along said North line of Seagate Unit One the South line of said Section 9 a distance of 2&96.67 feet to the Southwest corner of said Section 9; thence continua South 89 degrees 09 minutes 45 seconds West a distance of 225± feet to a point on the Mean High Water Line established May 15, 1968; thence in a Northwesterly direction along said Mean High Water Line a distance of 15,716± feet; thence departing said Mean High Water Line South 80 degrees 29 minutes 30 seconds East and along the Southerly line of Vanderbilt Beach Road (State Road 862) as recorded in D.B. 15~ Page 121 among said Public Records a distance o£ 7385± feat to a point on said West right-of-way line of State Road 45 (U.S. thence South 00 degrees 5gm,inures 36 seconds East along said West right-of-way line a distance of 257&.36 feet to the Point of Beginning. SECTION TEREE: Effective Date. "'Ap~ovld a~ ~o ~a and legal ~Is ~nce fll~ wi~ ~e Aasiatan~ County Atto~ey o~~~. ~ ~ ~ RESOLUTION PELICAN BAY IMPROVEMENT DISTRICT BOARD OF SUPERVISORS AMEND BOUNDARIES OF STREET LIGHTING DISTRICT WHEREAS, the Board of County Commissioners of Collier County, enacted Ordinance 78-67, as amended, creating the PELICAN BAY LIGHTING MUNICIPAL SERVICE TAXING DISTRICT; and WHEREAS, the Board of Supervisors of the Pelican Bay Improvement District, has the responsibility to do all things reasonably necessary to carry out the purpose of the Lighting District; and WHEREAS, the Board of Supervisors of the Pelican Bay Improvement District desire to amend the boundaries of the Lighting District, to include the real property described on the attached Exhibit "A", in order to carry out its purpose and effect; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF THE PELICAN BAY IMPROVEMENT DISTRICT: ' Section 1: The Board of Supervisors of the Pelican Bay Improvement District hereby request the Board of County Commissioners of Collier County to amend the boundaries of the Lighting District to include those areas as shown on Exhibit PASSED AND ADOPTED by the Board of Supervisors of the PELICAN BAY IMPROVEMENT DISTRICT this sixteenth day of December, 1987. n ../ ,IILES B.
