NOW, ~E~FORE, BE IT ~SOLVED BY THE BO~ OF C0~ CO~ISSIONERS OF COLLIER CO~, ~ORIDA, that: SECTION 0~: Confi~ the Creation of ~hs Marco Island Beautification Advisory Co~i~tem. This Ordinance ~s enacted pursuant to Ordinance No. 86-&i ~o confl~ creation of the ~rco Island Beautification Adv:Lsory Co~i:te8, hereinafter referred ~o as Ehe SECTION T~0: Appointment and Composition. The Committee shall consist of e~x (6) members which representation shall consist of one (1) member being an individual in good standing with their organization and recommended for appointment by the President of each of cha following Barco Island community organizations: 1. Barco Island Chamber of Commerce 2. Barco Island Civic Association 3. ~rco Association of Condominiums 4. Barco Island Jaycses 5. Marco Island Taxpayers Association 6. Barco Island ~omen's Club and one (i) member "At Large", not necessarily associated with any Marco Island organization. After publication of a vacancy notice in a publication of general circulation within Collier County and posted in the County libraries and County Courthouse, this "At Large" member shall be recommended for selection by review of qualifications and vo~e of the Committee. Members of the Co~mittee shall be appointed by and serve at the pleasure of the Board of County Commissioners. Each member shall be a resident and elector of the }Mrco Island Beautification Municipal Service Taxing Unit (hereinafter referred to as "Unit"). Appointment of members to the Committee shall be by resolution of the Board of County Commissioners, which resolution shall set forth the date of appointment, the term o£ office and applicable community organization in which the member would represent. SECTION THREE Terms of Office. The initial terms of office of the Committee members have been drawn by lot and shall be aa follows: Marco Island Chamber of Commerce member Marco Island Civic Association member Marco Association of Condominiums member Marco Island Jaycees membe~ Marco Island Taxpayers Association member Marco Island ~oman's Club member "At Large" member particular 2 years 3 years 3 years years ysars years years 2 2 I Thereafter, each appointment or reappointment shall be for a term of four years. Should a vacancy occur, that vacancy shall again represent his Marco Island Community Organization or "At Large" seat on the Committee and said vacancy appointment shall be filled in the same manner as specified ~n Section Two. Appointments to fill any vacancies on the Committee shall be for the remainder of the uuexpired term of office. Should a member resign prior to the complet~ou of his tarn of office, tha~ member should advise, in writing, the President of the organization which he represents if applicable, the Co~ittee Chairman and ~h~ Board of County C~issioners. SECTION FO~: Remov~ From O~ice; Failure ~o A~end Meetings. ~y me~e~ of ~he Co~i~ee may be removed from o~fice by a ~Jozi~y vo~a of ~ha Board of County Co~issioners. I~ any member of ~he Co~i~ce ~ails a~uend ~hree (3) consecutive Co~i~ee meetings ~i~hou~ a sa~isfac~o~ excuse, or if a member As absen~ ~o~ nora ~han o~e-cbi~d (1/~) o~ ~ha Co~i~ee's meanings in a given calendar year. ~he Co~i~ee shall declare ~he m~ber's sea~ ~o be vacau~ ~d ~he vacancy shall be filled in accordance wi~H ~his ordinance and]o~ by ~he Boar~ of County Co~issioners. SECTION F~: Office~s' ~o~m; Rules o~ Procedure. A) A~ i~s earliesu opportunity, ~ha membership of ~he Co~i~ee shall elec~ a chai~m and vice chai~n from ~ong ~he members. O~icers' ~e~ shall be for one (I) year, with eligibility for reelection. B) ~e presence of four (4) or more members shall constitute a of the Co~ittae necessary ~o take actiom and ~ransact business. C) The Co.tree shall, by majority vo~e of the en~ire membership, adopt rules of procedure for ~he ~ransac~ion of business and shall keep a ~it~eu record of mae~ings, resolutions, findings amd dare.nations. Copies of all Cool,tee minu~es, resolutions, reports, and exhibits shall be aub~tted ~o ~he Board of County C~issiomers. SE~ION SlX: Compensation. Members of ~ha Co~it~ee shall se~a wi~hou~ dompemsaulon, bu~ may be entitled ~o receive reimbursement for expenses reasonably incurred im ~he perfo~nce of ~hai~ duties upon prior approval of ~he Board of County Co~ssioners. SE~ION S~: Functions P~ers and Duties of the Co~i~ee. ~e func~ions, powers and duzies of ~he Co~i~ee s~ll be as follows: A) To aid and assist the Board of County Co~issiouers in carrying ou~ ~he purposes of ~be Uni~ as set forth in County Ordinance No. 8~-35. B) To prepare amd reco~end to the Board of County Co~issiomers an i~emized budget of ~he ~ount of money required ~o carry ou~ ~ha business of ~he Co~it~ee for the mex~ fiscal year. In carrying ou~ ~his ~esponsibili~y, the Committee shall, no later than April let of each year meet with the County Public Works Administrator or his Designee and outline to the Administrator those projects which Committee wishes to see accomplished during the next fiscal year. Based upon this information the Administrator or his Designee shall prepare a proposed budget for the Unit, in accordance with standard County guidelines regarding the preparation of budgets. This proposed budget shall then be reviewed by the Com~it~ee and upon approval by the Committee be transmitted through the Public Works Administrator to the Board of County Commissioners for adoption in accordance vith the procedures for the adoption of budgets set forth under general law and Board of County Co=issioners' policy. Should the Committee fail to approve'.a budget by May let of each year, the County Manager shall be au~horized ~o sub~i~ a proposed budge= co ~he Board of County Co=issionirs. SECTION EI~T: Duties of the County Public 9orks ldminist=aCor. ~a duties of :he County Public Works Administrator shall be: A) To adminis=~r the activities of the Unit in accordance with established policies of the Board of County Co~issiouers~ and guidelines adopted by tho C~icCee. B) To prepare the a=ual budget in accordance rich Section 7, Paragraph B, above. D) Attend all Co~i~coo meetings. m I S£CTION NINE: ltevtev ?rocess. This Committee shall be reviewed once every four (4) years commencing with 1990, in accordance with the procedures contained in Ordinance No. 86-41. SECTION TEN: Conflict and Severability. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and i~dependent provision of such holding shall hoc affect the validity of the remaining portion. SECTION ELEVEN: Effective Date. " This ordinance shall become effective upon receipt of notice from the Secretary of State that this ordinance has been filed with the Secretary of State.
