Y ovanovich, Esquire of Coleman, Yovanovich and Koester, P.A., representing The North Naples United Methodist Church, petitioned the Board of County Commissioners to change the zoning classification of the herein described real property. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE: The zoning classification of the herein described real property located in Section 10, Township 49 South, Range 25 East, Collier County, Florida, is changed from an Agricultural Zoning District to a Mixed Use Planned Unit Development (MPUD) Zoning District for the 13.0+/- acre project to be known as The North Naples United Methodist Church MPUD, to allow development of a maximum 1,900 seat church and church related facilities, a maximum 1,900 seat civic and cultural facilities, a maximum 200 student school and a maximum 209 unit adult PUDZ-2008-AR-13375 Rev. 6/21110 Page lof2 . assisted living facility in accordance with The North Naples United Methodist Church MPUD Document, attached hereto as Exhibits "A" through "G" and incorporated by reference herein. SECTION TWO: This Ordinance shall become effective upon filing with the Department of State. The maximum size for the continuing care retirement communities (CCRC), assisted living facilities (ALF) and independent living units for age 55 plus and similar facilities shall not exceed a floor to area ratio (FAR) of .60 with a maximum of 209 independent units in accordance with the operational characteristics contained herein. No building or structure, or part thereof, shall be erected, altered or used, or land used, in whole or in part, for other than the following: Tract A: Community Facility/Residential (CF/R) A. Principal Uses 1. Child Care Centers (Group 8351) 2. Churches & Places of Worship, not to exceed 1,900 seats (Group 8661) 3. Civic & Cultural Facilities such as amphitheatres, structures for theatrical, symphonic, orchestral and or operatic productions (limited to 1,900 seats), youth associations (i.e. YMCA/YWCA), fraternal/veterans lodges or associations, museums. 4. Community Garden (Group 0161) 5. Elementary and Secondary Schools, limited to 200 additional students in conjunction with the existing schools on the main church parcel adjacent to the north (Group 8211) 6. Individual and Family Social Services (Group 8322) limited to the following: (a) Activity Centers, elderly or handicapped (b) Centers for senior citizens (c) Community centers (d) Day care centers, adult and handicapped (e) Senior citizens associations (f) Youth centers 7. Any other principal use which is comparable in nature with the foregoing list of permitted principal uses, as determined by the Board of Zoning Appeals ("BZA") by the process outlined in the LDC. B. Accessory Uses Accessory use(s) located on Tract A may serve principal land uses on Tract A, or may serve as accessory uses to the same principal land use(s) as allowed on Tract A when those same principal use(s) are located on the abutting property to the north so long as both Tract A, or the applicable portion thereof, and the abutting property to the north are unified by a Site Development Plan. 1. Administrative Offices and Educational Facilities. 2. Ancillary Facilities, limited to power, HV AC and mechanical functions to serve permitted uses. 3. Church operated Thrift Store (Group 5932) not for profit only. 4. Columbarium, at grade level or above ground internment only (Group 6553) 5. Individual and Family Social Services (Group 8322) (a) Counseling centers (b) Family counseling services ( c) Marriage counseling service (d) Old age assistance (e) Outreach programs (f) Relief services, temporary (g) Service leagues (h) Temporary emergency shelters (limited legal occupancy under the fire code) 6. Employee/Staff Housing, limited to church staff only. Maximum of 2 units. 7. Personal services, dining, private restaurant/lounge, skilled nursing and other uses incidental to ALF and CCRC uses. 8. All such facilities will be permitted in compliance with Section 5.04.03 of the Collier County Land Development Code (LDC). 9. Retail sale of fresh, agricultural products, shall be limited to weekends and subject to a review of traffic circulation, parking, and safety concerns pursuant to the submission of a site improvement plan as provided for in section 10.02.03. (Group 5431; Vegetable markets and stands only) 10. Water Management Facilities/Lakes. 11. Customary accessory uses and structures including, but not limited to, signs, gate houses, private garages, tennis facilities, clubhouse, indoor and outdoor recreational facilities and swimming pools with or without screened enclosures, unlit playfields, playgrounds and similar facilities. 12. Any other use which is comparable in nature with the foregoing list of permitted accessory uses and is deemed consistent with the GMP, as determined by the Board of Zoning Appeals (BZA) through the process outlined in the LDC. Operational Characteristics for Independent Living Units for Persons Over Age 55: The developer of independent living units, its successors or assigns, shall provide the following services and/or be subject to the following operational standards: 1. The facility shall be for residents 55 years of age and older. 2. Total number of independent units shall be limited to 209. 3. There shall be on-site dining for the residents. 4. Group transportation services shall be provided for residents for the purposes of grocery and other types of shopping. Individual transportation services shall be coordinated for the residents' individualized needs including but not limited to medical office visits. 5. There shall be an on-site manager/activities coordinator to assist residents with their individual needs. The manager/coordinator shall also be responsible for arranging trips to off-site events as well as planning for lectures, movies, music and other entertainment for the residents at the on-site clubhouse. 6. A wellness center shall be provided on-site. Exercise and other fitness programs shall be provided for the residents. 7. Each unit shall be equipped to notify emergency service providers in the event of a medical or other emergency. 8. Each unit shall be designed so that a resident is able to age-in-place. For examples, kitchens may be easily retrofitted to lower the sink to accommodate a wheelchair bound resident or bathrooms may be retrofitted to add grab bars. Permitted Principal Uses and Structures in the Preserve (provided the minimum required preserve acreage is retained): 1. Passive recreational areas including recreational shelters. 2. Biking, hiking and nature trails, and boardwalks. 3. Native preserves and wildlife sanctuaries. 4. Water Management Facilities. 5. Any other use deemed consistent with the LDC for permitted uses in preserves or deemed compatible by the BZA at time of Development Order approval. Deviation#1 seeks relief from LDC Section 4.06.02(C)4, Buffer Yard Requirements, which requires an Alternative D Landscape Buffer to allow no landscape buffer along the entry drive providing access from Goodlette-Frank Road. If the property, or portions of the property, are developed as non-church related uses, the developer shall refer to the landscape buffering requirements outlined in the LDC at the time of site development. 2. A deviation from LDC Section 4.05.04.G which states that multi-family clubhouse structures require parking spaces at a ratio of 1 parking space per 200 square feet and swimming pools require parking spaces at 1 per 75 square feet for the first 1,000 square feet and 1 for each additional 125 square feet of water areas, in order to provide parking for a clubhouse and outdoor pool associated with an ALF at a ratio of 1 parking space per 800 square feet, or 25% of the required clubhouse parking standard. Preserve Area Calculation: 7.93 acres (existing vegetation) x 15% = 1.19 acres to be preserved. 2. Native plantings in all three strata shall be required to be added to the preserve areas where there is removal of non-native and/or nuisance vegetation. A planting plan shall be submitted at the time of application for plat or site plan approval immediately following the approval of the rezone. TRANSPORTATION 1. Access to this parcel shall be limited to the shared access with the existing North Naples United Methodist Church (parcel no. 00240280208). No direct access to Goodlette Frank Road is allowed. A perpetual cross-access easement must be granted from the parcel to the north (currently under the same ownership) to provide access to this PUD. 2. Day care students may not exceed a total of 50 enrolled students at any time. 3. The maximum trip generation allowed by any combination of the proposed uses (both primary and ancillary) may not exceed 128 PM Peak Hour, two way trips; as analyzed by the traffic study associated with this project. 4. For services and other periods and events of significant traffic generation, as determined by Collier County Staff, the property owner shall provide traffic control by law enforcement or a law enforcement approved service provider as directed by Collier County staff, with staffing and locations(s) as directed by the County Manager or his designee.
