Ordinance 89-081 OFFICER OF THE COLLIER COUNTY CORRECTIONAL ~n~, SYSTEM PURSUANT TO THE PROVISIONS OF ~ECTION~, CONFLICT AND SEVERABILITY; PROVIDING AN "~" ~.: WHEREAS, the Sheriff of Collier County is in the best position to enforce all existing County and State laws and administrative rules of the Department of Corrections concer~ing the operation and maintenance of the Collier County Correctional S~ste~; and ~HEREAS, the Board of County Commissioners of collitr County, Florida, finds that it is in the best interest of the citizens of Collier County to designate the Sheriff of Collier County as the Correctional Officer of the Collier County Correctional System. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: ~J~_~Z~. Findings Section 951.061, Florida Statutes, provides that the Board of County Commissioners, by majority vote, may adopt an ordinance designating the Sheriff as the Chief Correctional Officer of the county correctional system and further provides that ha shall appoint such officers as he deems necessary and as are required by rule of the Department of Corrections. Collier County Sheriff Designated as the Chief correctional Officer Pursuant to the provisions of Section 951.061, Florida Statutes, the Sheriff of Collier County is hereby designated the Chief Correctional officer of the collier County Correctional systn, which includes the Collier County Jail and th& Immokalee Stockade, and he shall appoint such officers as he deems necessary and as are required by rule of the Department of Corrections. The Sheriff or his designee shall enforce all existing state 1 concerning the operation and maintenance of the Collier County Sail and the Collier County Stockade. ~T~I~. Conflict and Severability In the event this Ordinance co~flic~a vith any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any cour~ of competent ~uriediction, such portion shall be deemed a separate, dietinc~c and independent provisions and such holding shall not affect the validity of the remaining portion. ~.
