SOS FLEXIBLE XIR DUCT CONNECTOI~ SOS.1 General Amend subsection 505.1 by adding Provision S to read as follows: .. .. S. All flexible ducts shall meet UL181 Claes I duct specifications and shall be so labeled. All horizontal runs of flexible ducts shall 'be supported a minimum of every three (~) fe~=. All ver=ical runs of £1uxlblc ducts shall be supported a minimum of every six (6) feet. All connections of flexible ducts, plenums, trunks, systems or mixing boxes shall use e mechanical connector and shall be air tight. When Class i flexible ducts are (2) ,oo, 80 installed in accordance with the above spsclflcatlons thers shall be no lsngth limitation, PLENUM~MBERS Add 512.3 to read as follows: 512.3 All supply and return plsnum chambers shall have minimumclearance of 4# on all sides for accessibility. Add subsection 603.6 to read as follows: 603.6 Insulation All condensate lines, except emergency pan drains and blow through units, shall have a trap in line. The line must be insulated to prevent condensation. Schedule eighty (80) PVC pipe may be used without insulation. ~PPENDXX A SUPPLEHENTAL ~DMXNISTRATXFE PROVISIONS AX03.7,X Fees ~X03.7.1 ~e Board of County Co~lssioners shall es=ablish, by Resolution, a schedule of fees and charges for ma~ters pe~aining to this Ordinance and associated ma~ters. It is the inten= of these regulations tha= the County shall no= be re, ired to bear any par~ of the cos= og applications made ~der this Ordinance. The schedule of fees and charges shall be posted in the Development Services Department. The schedule of fees and charges may be changed by resolution of the Board of County Commissioners and are not subject to the procedure otherwise necessary for amendment of this Ordinance. AXOS.4 BOARD MEMBERS ~ND PROCEDURES Delete section A105.4 in its entirety. Refer to the Board of Adjustments and Appeals Ordinance. ~X07 - VIOLATIONS AND PEFALTXES Amend section to read as follows: If any person, firm, corporation, or other legal entity shall fail or refuse to obey or comply with, or violates, any of the provisions of this ordinance, such person, firm, corporation, or other legal entity whether public or private, upon conviction of such offense, shall be punished by a fine not to exceed Five Hundred Dollars ($500.00) or by imprisonment not to exceed sixty (60) days in the county Jail, or both, in the discretion of the court. Each day of violation or non-compliance shall be considered as a separate offense. In addition, any person, firm, corporation, or other legal entity whether public or private, convicted under the provisions of this section shall pay all costs and e~penses involvsd in the case. Nothing herein contained shall Prevent the County from taking such other lawful actTon in ant. court of competent Jurisdiction as is necessary to preven~ or remedy any violation. Such other lawful action shall include, but shall not be limited to an equitable action for injunctive relief, and an action a~ law for damage. Further, nothing in this Section shall be construed to prohibit the County from prosecuting any violation of this Ordinance by means of a Code Enforcement Board established pursuant to the authority of Chapter 162, Florida Statutes. All r.medies and penalties provided for in this Section shall be cumulative and independently available to the County and the County shall be authorized to pursue any and ell remedies set forth in this Section to the full extent allowed by law. SECTION THREE: REPEAL Collier County Ordinances 86-50 and 87-23 ars hereby repealed in their entirety as of the effective date of this ORDINANCE. SECTION FOUR: CONFLICT AND SEVERANCE IN THEEVENTTHIS ORDINANCE CONFLICTS WITH ANYOTHER ORDINANCE OF COLLIER COUNTYOROTHERAPPLICABLELAW, THE HORE restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of competent Jurisdiction, such portion shall be deemed a separate, distinct, and independent provision and such holding shall not affect the validity of the re~aining portion. SECTION FIVE= EFFECTIVE DATE This Ordinance shall become effective upon receipt of notice from the Secretary of State that this Ordinance has been filed with the Secretary of State.
