SEWER; DELETING SECTION A105.4 IN ITS ENTIRET~_.~ AMENDING SECTION A107 RELATING TO VIOLATIONS PENALTIES; REPEALING ORDINANCES 86-51 AND PROVIDING FOR CONFLICT AND SEVERANCEs PROVIDING NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY ~-~ COMHISSIONERS OF COLLIER COUNTY, FLORIDA~ ~--~-~ ~ECTION ONE The #Standard Plumbing Code, 1988 Edition with the 1989 'Revisions", including Appendixes A, B, C, D, G, I, J, and K, as published by the Southern Building Code Congress International, Inc., and as amended herein, is adopted by reference as the "Collier County Plumbing Code" to protec~ ~he health, welfare, safety, common interest and convenience of the citizens, visitors, and residents of Collier County, Florida. SECTION TWO The "Standard Plumbing Code, 1988 Edition with the 1989 Revisions", including Appendixes A, B, C, D, G, I, J and K is hereby amended to r~ad as follows: C~TEH ~ ~DMINISTRATION ~05 BOARD OF ~D~USTMENTS ~ APPEALS Amend section 105 to read as'follows= ~05 BO~D OF AD~USTHEh~ Ah~A~E~S Whenever the Plumbing Official shall reJec~ or refuse mode or manner of construction proposed to be followed or materials (1) lOOK to be used in the erection or alteration o~ & building or structure, or when it is claimed that the provisions of this cod~ do not apply, or that an equally good or more desirable form of construction can be employed in any specific case, or ~nen it is claimed that the t~ue intent and meaning of this coda or any of the regulations thereunder have been misconstrued or wrongly interpreted, the owner of such b~ilding or stk-ucture or his duly authorized agent, may appeal from the decision of the Plumbing Official to the Board of Adjustments and Appeals, pursuant to the procedures as set forth in the Collier County Ordinance establishing the Board of Adjustments and Appeals. C]~LPTER 12 ~ATER SUPPLY AND DISTRIBUTION 120! ~ATER SUPPLY CONTROL 1209,3 Controls For Fixtures Within Dwellings Add subsection 1209.3.3 to read as follows= 1209.3.3 All living units in apartment or residential type buildings shall have a readily accessible main water supply shutoff valve. This valve shall not be located behind any fixtures or appliances. Easy access shall be maintained on all supply valves. ]LPPENDIX "AH SUPPLEMENTAL ADMINIBTRATIFB PROVISIONS · 103.7 Fees Amend subsection A103.7.1 to read as follows: A103.7.1 Prescribed Fees. The Board of County Commissioners shall establish, by resolution, a schedule of fees and charges for matters pertaining to this Ordinance and associated matters. It is the intent of these regulations that the County shall not be required to bear any part of the cost of applications made under this Ordinance. The schedule of fees and charges shall be posted in the office of the Development Services Department. The schedule of fees and charges may be changed by resolution of the Board of County Commissioners and are not subject to the procedure otherwise necessary for amendment of this Ordinance. 1103.S.7 Drainage and Vent Tests Amend section A103.8.7 to read as follows: ~103.9.7.1 A water test shall be applied to the drainage system either in its entirety or in sections. If applied to the entire system, all openings in the piping shall be tightly closed, except the highest opening and the system filled with water to point of overflow. If the system is tested in sections, each opening shall be tightly plugged except the highest openings of the section under test, and each section shall be filled with water, but no section shall be tested with less than 5 ft. head of water. In testing successive sections, at least the upper 5 ft. of the next preceding section shall be tested, so that no Joint or pips in the building (except the uppermost 5 ft. of the system) shall have been submitted to a test of less than a 5 ft. head of water. The water shall be kept in the system, or in the portion under test, for at least 15 minutes before inspection starts; the system shall then be tight at all points. In lieu of a test, a visual inspection may be accepted when all Joints for plastic pipe and fittings are installed with the application of a proper colored cl.aner prior to the application of solvent cement. X105.4 Board Members And Procedures Delete section A105.4 in its entirety. Refer to the Board of Adjustments and Appeals Ordinance. XX07 VIOLATIONS AND PENALTIES If any person, firm, corporation, or other legal entity whether public or private, shall fail or refuse to obey or comply with, or violates, any of the provisions of this Ordinance, such person, firm, corporation, or other legal entity whether public or private, upon conviction of such offense, shall be punished by a fine not to exceed Five Hundred Dollars ($500.00) or by imprisonment not to exceed sixty (60} days in the county Jail, or bo~h, in the discretion of the court. Each day of continued violation or non-compliance shall be considered as a separate offense. In addition, any person, firm, corporation, or other legal entity whether public or private, convicted under the provisions of this section shall pay all costs and e~ensee involved in the case. Nothing herein contained shall prevent the County from taking such other lawful action in any court of competent Jurisdiction as is necessary to prevent or remedy any violation, such other lawful action shall include, but shall not be limited to, an equitable action for injunctive relief and an action at law for damages. Further, nothing in this Section shall be construed to prohibit the County from prosecuting any violation of this Ordinance by means of a Code Enforcement Board established pursuant to the authority of Chapter 1E2, Florida Statutes. All remedies and penalties provided for in this Section shall be cumulative and independently available to the County and the County shall be authorized to pursue any and all remedies set forth in this Section to the full extent allowed by law. BECTIONTItREE: REPEAL Ordinance Numbers 86-51 and 87-22 ara hereby repealed - in their entirety as ~f the effec~ive d~te of this Ordinance.
